ORDINANCE NO. 545
ORDERING THE VACATION OF MAGNOLIA AVENUE
IN SUBDIVISION OF LOT 2, BURR'S ADDITION

WHEREAS, this City Council, acting in accordance with the
provisions of Part 3 of Division 9 of the Streets and Highways
Code of this State (the Street Vacation Act of l941), did on
the 5th day of October, 1855, pass and adopt its Resolution
of Intention No. 1883, therein declaring the intention of said
City Council to vacate Magnolia Avenue in Subdivision of Lot
2, Burr's Addition to Lodi, as particularly described in said
Resolution, and
WIiERW, notice of said intended vacation was regularly
given by publication and by posting, both in time, form and
manner as required by law as is evidenced by affidavits on
file and of record in the office of the City Clerk 09 the City
of Lodi, and
WHEREAS, in accordance with the provision stated in said
Resolution No. 1883 and also contained in the posted notices
of the adoption of said Resolution, notice was given that a
public hearing would be held before said City Council in the
City Council Chambers , City Hall, Lodi, California, beginning
at 8:oo ofclock p.m. of Wednesday, Decemb
and when any person interested in or objecting to said street
vacation could appear and be heard in relation thereto, and

determine that said street is unnecessary for present or future
public use and did so find and declare, now therefore,
THE CITY CODNCIL OF TH!E CITY OF LODI DOES ORDAIN AS FOLLOWS:
Section 1. The following described street in the City of
Lodi is hereby ordered vacated, closed up and abandoned:
MAGNOLIA AVENUE AS SUCH SAID STREET IS DESIGNATED
ON THAT CERTAIN MAP ENTITLED "BURRrS ADBITION TO LODI
SUBDIVISION OF LOT NO. 2" FILED MCH 31, 1888,
RECORDS OF sm JO~QUIN COUNTY.
Reference is hereby made to a map or plat on file with the office
of the City Clerk of the City of Lodi for the particulars as
to the vacation.
Section 2. This ordinance shall be published one time in
the "Lodi News-Sentinel", a newspaper of general circulation
printed and published in the City of Lodi and shall be in force
and take effect at the time and in the manner provided by law.
The City Clerk shall cause a certified copy of this ordinance
to be recorded in the office of the County Recorder of San
Joaquin County as required by Section 8324 of the Streets and
Highways Code of this State.

regularly introduced in the City Council of said City on
December 7, 1955, and was thereafter passed, adopted and
ordered to print at a subsequent meeting of said City Couricil
held on December 21, 1955, by the following vote:
AYES : Councilmen - Fuller, Hughes , Mitchell, Richey
NOES : Councilmen - None
ABSENT: Councilmen - None
