HomeMy WebLinkAboutOrdinances - No. 348OR3INANCE XO. 34$ AN OI1DIEul.U~CE :\PPROVIIE% THE AiYRrMEXk- TION OF "CAIN-HAZ.ARi7 ADDITION" TO THE CITY OF LODI, CALIFOFNIA. ._ i ?fflIERZAS, in answer to a petition signed by the owners of not less than one-fourth of the area and representing not less than one- fourth of the assessed value of the territory hereinafter described, this City Council did, on the 16th day of April, 1947, pass and adopt its Resolution No. 1311 declaring it to be the intention of said City Council to annex to the City of Lodi certain uninhabited territory contiguous to said City, in accordance with the proceedings had and to be had pursuant to the provisions of the '!Annexation of Uninhabited Territoq Act of 1939" as Tended, said territory for the purposes hereof to be designated for identification as "Gain-Hazard Addition" and particularly bounded and described as hereinafter set forth, and, '%EREAS, due publication of said Resolution PJo. l3ll was had in time, form and manner as required by law is evidenced by affidavit on file and of record in the office of the City ClerK of this City, and, "dREAS, among other things, the said Resolution t!o. 1311 gave public notice thst owners of real property affected by said annexation might file written protests Against said annexation up to the hour of 8:OO ofclock P.N. of Yednesday, Bray 7, 1947 with this City Council, which protests would be received and considered at said day and hour in the City Council Chambers, City Hall, Lodi, California, and, 'WERZAS, at that place and on that day and hour this City Council did in open regular meeting declare that it was then ready to receive and hear any and all protests or objections against the annexation of said territory to the City of Lodi and no protests either written or oral were presented, and by reason that no protests were received, this City Council did then and there acquire jurisdiction to annex said territory to the City of Lodi, now therefore. The City Council of the City of Lodi does ordain as follows: Section 1. The annexation of the following described uninhabi- ted territory contiguous to said City of Lodi, County of San Joaquin, State of California is hereby approved and is hereby declared to be annexed to and made a part of said City to-wit; A portion of Lots 1 and 5, in Block 13, Hutchins Addition to Lodi, as per map thereof filed April 10, 1897 in Vol. 1, at page 58, Book of Maps and Plats, San Joaquin County Records, and portion of the Pbrtheast Quarter of Section 2, Township 3 North, Rarge 6 East, Elount Diablo Base and Meri- dian, San Joaquin County and being more particularly described as follows: Beginning at a point on the east line of said Lot 5, 289.5 feet, more or less, south of the northeast corner of said Lot 5, said point of beginning being also the northeast corner of the Fugazi property as described in deed filed in Book A of Deeds, Vol. 472 at page 365, San Joaquin County Records; Northerly along said east line and its northerly projection, 643.14 feet to the south line of ?Jest bckeford Street; thence westerly dong said south line, 541.4 feetto the east line of the Fugazi property as described by deed Piled in Book A of Deeds, Vol. 92, at page 43, San Joaquin County Records; southerly along said east line 384.6 feet to a point on the north line of said Lot 1, said point being easterly, 401.5 feet from the northwest corner of said Lot 1, thence South and parallel to the west line of said Lot 1, 287.2 feet to a pipe; ly and parallel to the south line of said Block 13, 573.5 feet to the point of beginning, containine 8.5 acres, more or less.
