HomeMy WebLinkAboutOrdinances - No. 26ORDINANCE NO. &o AN ORDINANCE PROHIBITING GAMBLING GAMES AND PRESENCE THEREAT BY IMPOSING PENALTIES IN RELATION TO THE SAME. The Board of Trustees of the City of Lodi do ordain as f 0 110 ws : Section 1.- Every person who, within the City of Lodi, deals, plays, participates in, opens or carries on, or who, either as owner or employee, whether for hire or not, conducts, any game played with cards, dice, machine or other device, for money or representative of money or other thing of value, is punishable by imprisonment in the county jail of the county of San Joaquin or the city-jail of the City of Lodi not to exceed ninety days or by a fine not to exceed one hundred doilars or by both such imprisonment andfine or by such fine with a direction in the-’ judgment that the defendant be SO imprisoned until the fine & satisfied, the judgment specifying the term of such imprisonment which must not exceed one day for each dollar of the fine. Section 2.- Every person who, knowing or having reason to know that any game prohibited or described in section one of this ordinance aforesaid or by section three hundred and thirty-of the penal Code or by any other statuary provision of the State of California, is being dealt, played, opened carried on or con- ducted, remains present thereat after SO kndwing or having reason to know, is punishable by imprisonment in the county jail of the Sounty of San Joaquin or the city jail of the City of Lodi not to exceedsixty days or by a fine not to exceed one hundred fiollars or by both such imprisonment and fine or by such fine vith a direction in the judgment that the defendant be so imprisone until the fine is,satisfied, the judgment specifying the term of such imprisonment m5% which must not exceed one day for each ioliar of the fine. Section 3.- Nothing in this ordinance authorizes the prosecu- tion under this ordinance of any act or conduct which constitutes an offence under the provisions of section three hundred and thirty of the Penal Code or any other statutory provision of the State of California, nor does this ordinance authorize imprisonment eor a term greater than three months. Section 4.- This ordinance shall be published at least once is the xL 19* He-, a newspaper published in the City of Lodi, and shall take ~[e%%amB; and+.have effect from and after the day of such publication.
