Section 1. - A public pound is hereby authorized and the same silall be located at some coiiveiiient place to be fixed by the Board of Trustees, which said pound shall be and remain under charge ald coriti-01 of the L'Iarshal in absence of a Pouiid IJaster appointed bjr the Eo22d of Trustees. Secticn 2. - It is hereby made unlawful for any OX, bull, COW, horse, colt, jack, jenny, mule, calf, sheep, goat, hog, to run. at large in the City of Lodi, or to be pastirred or herded, tied 01- stdced, in any of the streets, alleys, squares or other ground belonging to or under control of said city. Section 3.- It shall be the auty of the Uarshal or Pound Biaster to take up, impotmd, arid safely keep any of the animals enumerated. ic Section 2 of this ordinance found running at large, or being herded. or pastui-ed in any street, square or other public grouad or place, contrary to the pro- visions of Seetior!. 2 of this Ordinance. When any animal is SO irnpoundea, the Karshal o:c Pound Isiaster shall immediately notify the owner or .owiiers thereof, if unknovin, by posting notices in at least three public places, for the space of one week. Said notice shall contain a full description of such animals and set forth that unless reclaimed they will be sold under the State law pyovided for,estrays. If said animals are not reclaimed befoi-e the expiration of the time specified in the notice the Narshal or Pound Kaster shall proceed to sell the same in the manner specified in the notice. ?3DEI!PTCION 03' IKPOUXDED A.IJIId.AL S. Section 9. - If any persons fail or neglect to bury any animal as provided for in this ordinance, then in such case it shall be the duty of the Narshal or Pound Master to proceed forthwith to have the same buried, and it shall be la17Jful for the IGarshal or Pound lJiaster to charge to and recover frou the oviner or possessor of such dead animal the cost of burial thereof; alld such person who shall neglect or refuse to bury or cause to be buried dead animal upon his pi-ernises or in any public place, of which he is the o',mer or possessor, or to p@y the Ilarshal or Pound Lfaster the cdst incurre3 in burying such animal shall be guilty of a misdemeanor, and upon conviction there- of, shall be punished by a fine of not less thata five dollars, nor more than thirty dollars, or by impr'sonment not less than five nor inor:: than ten days, or by kth such fine an& imprisonment. In case the Uarshal or Pound idaster after diligent search, cannot find the owner or possessor of an37 dead animal, in this Ordinance referred to, he shall cause the same to be buried, and the cost thereof shall be paid by the city. XESCUING ABIltALS, PENALTY. Section 10. - If any person shall rescue any animal from the ITarshal or Pound Laster or any person auth- orized to ixpound anixals, while conveying or being about to convey or &rive the same to the pound, or shall make any pound breach or in any way, directly 'or indirectly, convey or deliver or remove any animal out of the pound without lawful authority, he shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than five nor more than fifty dollars or by im- prisoment for not less than five or more than thirty days, or by both such fine and imprisonment. Section 11. - The Uarshal or Pound Master shall keep a recora of every animal in pourid with description thereof, and the date aild manner of disposition of same, whether notice w4s given to the owner, and the date such notice was given, and, if sold, the name of the person to whom sold. Said record shall be open to inspection of any person upon demand. PENAL TT'. Section 12. - Any person owning or haviag control of my animal in violation of any provision of this Ordinance an& any person violating any provision of this Ordinance in any other particular, shall be deemed guilty of a misdemeanor, and upon coilvietion thereof shall be punishea (uifiess other- wise provided herein) by a fine not exceeding fiftz dollars or by irnprisonment not exceeding tnecLy five says or by both such fine and imprisonme11t. Section 13. - The office of City Pound Master is hereby establishea. T'ne City Pound Naszter shall be appointed by and shall hold office at the pleasure of the Board of Trustees and shall receive such coupensation, in addition to coripensatioiz herein provided for, as said Board of Trustees may lrom tiae to time provide for. -5- .. Section 14. - All ordinances and parts of ordinances in conflict herewith are ‘hereby repealed. clause, phrase or iaford of this oidinance shall be held or declared to be unconstitutioaal, the same shdl not affect tile constitutio11ality and validity of an;r other part, paragraph, clause, section, phrase or 1vor3 of this ordinance, the Boa% of Trustees hereby declaring its each section, paragraph, clause, phrase and part of this ordinance without regarcl to any other. Section 15. If ang pal-t, paragraph, section, intention to pass and adopt Section 16. - This ordinance shall be published once iil the Lodi Uews, a nemspager published in said city of LoCii, and shall be in force and take effect thirty days after its passage am3 publication.
