ORDINANCE NO. 1454
AN ORDINANCE OF THE LODI CITY COUNCIL
AMENDING THE LODI MUNICIPAL CODE BY ADDING THERETO
CHAPTER 9.18 REGULATING PEDDLERS I , VENDORS , OR ITINERANT
MERCHANTS' ACTIVITIES ON PUBLIC STREETS AND SIDEWALKS
BE IT ORDAINED BY THE LODI CITY COUNCIL AS FOLLOWS:
SECTION 1. The Lodi Municipal Code is hereby amended

by adding

ties on public streets and sidewalks, as fol ows:
Notwithstanding the provisions of Lodi Municipal Code §
10.44.080, it shall be unlawful for any person, firm, or
corporati on engaged in sell i ng or di stri buti ng any goods , wares ,
or services from other than a pushcart, vehicle or wagon, to
stop, stand or remain on or along a public street or sidewalk for
a period longer than ten minutes without moving to a new
location at least one hundred feet removed therefrom.
59.18.020
It shall be unlawful for any peddler, vendor, or itinerant
merchant to operate in a place upon such public street or
sidewalk where such operation will create a traffic hazard.
§9.18.030
In no event shall any such peddler, vendor or itinerant merchant
operate within:

A. Three hundred feet of any school grounds on any day
when school is in session;
B. One hundred feet of any street intersection controlled
by a traffic light or 4-way stop sign.
9.18.040 Exemption
This section shall not apply to the sale or distribution of any
newspaper, flier, or handbill.
9.18.050 Penalties
Any person violating any of the provisions or failing to comply
with any of the mandatory requirements of this chapter shall be subject
to the foll owing penal ties:
1. A person convicted of a violation of this chapter shall be
guilty of an infraction, punishable by a fine not
exceeding one hundred dollars for a first violation;
2. A fine not exceeding two hundred and fifty dollars for a
second violation of the same provisions within one year;
Third and subsequent convictions for violations of this 3.
chapter during any one year period shall be deemed a
misdemeanor, punishable as specified in $1.08.010 B of the
Lodi Municipal Code.
SECTION 2. All ordinances and parts of ordinances in conflict
herewith are repealed insofar as such conflict may exist.

SECTION 3. This ordinance shall be published one time in the "Lodi
News Sentinel", a daily newspaper of general circulation printed and
published in the City of Lodi and shall be in force and take effect
thirty days from and after its passage and approval.
