HomeMy WebLinkAboutOrdinances - No. 1373ORDINANCE NO. 1373 AN ORDINANCE OF THE LODI CITY COUNCIL ANENDING LODI MUNICIPAL CODE TITLE 10, CHAPTER 10.32 RESIDESJTIAL PEWIT PARKING BE-IT O€X"ED BY THE LODI CITY COUNCIL. SIXI'ION 1. This ordinance mdment is enacted pursuant to the authority contained in Title 10, Residential Pennit Parking, Chapter 10.32, Section 10.32.010 of the Lodi Municipal Code and California Vehicle Code Section 22507. SECTION 2. Title 10, Chapter 10.32 - Residential Permit Parking, is hereby amended as follows: Section 10.32.010. Statutory authority. The ordinance codified in this chapter is enacted pursuant to i the authority contained in California Vehicle Code Section 22507. Section 10.32.020 Zone Designation. A. The Council may designate by resolution from th to th, certain residential streets or any portions thereof as a pre parking zone for the benefit of residents adjacent thereto zone vehicles displaying a permit or other authorized indicia exapt frm parking prohibitions or restrictions otherwise marked or noticed, for such periods of the as designated in the resolution. B. No preferential parking ordinance shall apply until signs or markings giving adequate notice thereof have been placed. Section 10.32.030 Permit Requ ‘red. No person shall park or leave standing on such street or portion thereof, any vehicle unless such vehicle has displayed thereon an appropriate permit issued by the Finance Director which entitles the holder thereof to preferential parking privileges on the street or portion thereof in question. Section 10.32.040 Application for Permit. Each application for a parking permit shall contain information sufficient to identify the applicant, his residence address on a street within the residential parking permit area, the license n-r of the mtor vehicle for which application is made and such other information that may be deemd relevant by the Finance Director. Section 10.32.050 Issuance of Pennit. A. Parking pennits shall be issued by the Finance Director. No mre than one parking permit shall be issued to each mtor vehicle for which application is made. The Finance Director is authorized to issue such rules and regulations, not inconsistent with this chapter, governing the manner in which persons shall qualify for parking permits. B. Parking permits may be issued for mtor vehicles only upon application of a legal resident of property adjacent to a street within -2- ... the residential permit parking area who has a mtor vehicle registered in his nam or who has a motor vehicle for his exclusive use and under his control. C. Proof of residency and motor vehicle ownership or vehicle use and control shall be demonstrated in a manner determined by the Finance Director. Section 10.32.060 Term of Permit. Permits issued pursuant to this chapter shall remin effective for a period of three calendar years or fraction thereof, or so long as the applicant continues to reside in a qualified dwelling unit for such permit or until the preferential parking zone for which such pennit was issued is eliminated, whichever period of tim is less. Section 10.32.070 Display of Permit. Permits shall be displayed on the left rear bumper of the vehicle for which the permit is issued. Section 10.32.080 Fee. The Finance Director shall collect a fee for each original permit issued and for each renewal permit issued in an aunt to be determined from tim to tim by resolution of the City Council. Fees are payable for three calendar year periods of the only and fees will ' not be prorated for lesser periods of tim. A new section is added to read as follows: -3- Section Term of Permit Parking. The permit parking shall be effective for periods of time as designate3 on the sign giving notice thereof. A new section is added to read as follows: Section . Transfer of Permit Prohibited. Parking permits issued to the wtor vehicle of the legal resident of property are issued exclusively for that resident's mtor vehicle and shall not be transferable to any other party. Upn relinquishing ownership of a vehicle for which a permit was issued, the resident shall: a. b. notify the Finance Director within five days, and remve the permit frm the vehicle A new section is added to read as follows: Section . Adherence to Other Provisions of the Municipal Code and California Vehicle Code. No vehicle for which a permit has been issued hereunder shall be parked upon any street or alley in the city in violation of any part of this municipal code or in violation of the California Vehicle Code. -4- Section 10.32.090 Exemptions. The provisions of this chapter shall not apply to any delivery vehicle, which vehicle is under the control of an individual providing service to property located on a street in a residential permit parking area; nor to any emergency motor vehicle including, but not limited to, an ambulance, fire engine, police vehicle or other City vehicle providing City service. Section 10.32.100 Violation--Infraction. Pursuant to Government Code Section 36900, violations of this chapter are designated infractions. SECTION 3. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 4. This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval. #!+gf@Zw this 5th daqofsFebruary, 1986 Attest : ALICEM.
