Seation 1. The City of Lodi hereby grate to Central Calif-
ornia Traction Company, a railroad oorporation duly organized
and existing under and by P-lrtue of the Law8 of the State of
California, and transacting business in the County of San Joaquin,
State of California, its sucoessors in interest and assims, th6
right, privilege an8 permission to aonstruct, lay down, naintain
and operate a spur railroad trauk of at&hdsr& gauye, for the trans-
portation of freight, togehter with tk riRht, privilege and per-

m6 aonneations, and the right to run cars thereon ant! thereunder,
propelled ana operated by electricity, or by any other lawful mo-
tPve power, except horses and mulee, witk all. the neoessarjr poles
and ovsrheaa or underground wire@, on, over , don%, upon and
aoross tbe streets, portlons of streets, avenues and other places
fa the City 0% Lodi, County of Qm Joaquin, State of Gdifornia.,

Seetion 2. The franchise, rights, privileKes an8 permieai ow
herein manted to &aid Grantee %re dependent for their oontinuance
and validity upon the performance by said Grantee in fnl1 of all eon-
ditions as hereinafter set out, to-wit:

and maintain its said roadbea in ssid City of Lodi to the offieid
grade OT the satd streets and portions of streets in said City of
Lodi, and shall. not constract or raise any portion of his roadbed
to a greater hei&t than said off1cia3. qrade, unless with the per-
mission of the m3.B Board of Trustees, of the City of ZoBi,

seleoted by the Board of TrUStae8 of the City of LoBi, now, or
at my time during the life of said franokiss, and shall keep suoh
oulverts in constant repair,
Third---S&i& Grantee shall, upon the order of the said Board
af Trustees of the City of Lodi, grade or refwade, gravel or re-
@awl, plmk or replank, pave or repave, macadamize or remacadamize p
pile or replle, with suoh material as shall be orderea by said
Board of Trustees, of the aaid City of Lodi any and all portions
of said streets alona which the track ie laic¶, between the rails
thereof, and fo; a width ex$ending two feat on each side of said
Braok.
It shall keep the same, inoludiog the oroseings oonstsntly
in repair and flush with the streets, md in ame crossings are
taken up they must be replaoed immediately after tk# completion
bf the work. All work must be done under the supewfsion an8 to
the satisfaction of the Superintendent of Streets, and ;In no uase

permitted to run or operate said railroad on said straets or por-

Trustee 8.
Section 4. Said Grantee shall keep ita roadbed and track in
good condition, with proper slopes to enable teams to pass an8 re-
paw thereon.
Saotion 5. ALL prfvileees and rights required by said Grantee
for the constrnction and xlaintenmae af said roa&bed, track, curves,
crossings and conneationa through private property, and upon sfratlea
made by private perams me to be by said Crates seollred from the
owners of suoh propertg.

the franchise, rip-te, privileges and permissions herein qantbd,
or to cmmeaoe in god 2aith and duly.proseante the cmetruotion
of his eaid railroaa mKtbia sixty days from the date of the approv-
-al of this Ordinance, then this Ordlnanca shallbe of no
affect as a grant unto the said Grantee.
