LODI , CALIFORNIA, AND DEFINING THE TEiPZ 'ICUSIB €?3TURN, It DEFIBIdG
.4ND ESTABLISHING THE LOCATIOIV OF GUTTERS, AYEJ REPEALING ALL OR-
DI-MNCES, OH PARTS OF OHDINANCES, TI? CONRLICT WIT3 THIS ORDIN-
ANCE.
WHEREAS, The BBclrd of Trustees of the City of Lodl
did, on the 12th day of May, A. D. 1919, adopt its Resolution of
Intention No. 21, to change, modify, establish and re-establish
the grades of certain streets and avenues in said City, and to fix curb lines on certain streets and avenues in said City, as
more particularly set forth in said Resolution of Intention No.
21; and,
WREAS, Gaid Resolution of Intention was published
in "The Lodi Sentinel, a tri-weekly newspaper, published and cir-
culated in the said City of Lodi, for two weeks, and was posted
by the City Clerk for two days conspicuously on or near the Coun-
cil Chamber Door of said Board of Trustees, all as required by
law; and,

WHElUCAS, The Superintendent of Streets did issue

conspicuously on and along the streets and avenues des-
n said Resolution of Intention No. 21, which said notice was headed "Notice of Change of Grade," in letters not less than
one inch in height, and was published in the aforesaid, "The Lodi
Sentinel, (I for two weeks, and that he posted not less than three
notices in all, and said notices were not more than one hundred
feet apart, all as required by law; and,
WHEIUAS, Affidavits or proofs of the publication in
said "The Lodi Sentinel," of said Resolution of Intention No. 21,
and of said "Notice of Change of Grade," have been made, and are
now on file in the office of the City Clerk of the City of Lodi;
and,
WKElGAS, No protest or objection to said proposed
c-hange or modification of grade wr6 made or filed with the City
Czerk of said City; and,
WFBREAS, More than thirty days have elapsed since
the first publication of the Notice of the Passage of Resolutlon of Intentbn No. 21; .v

curb at the several and respective points herein above mentioned are .
hereby established at eight-twelfths of one foot below the curb grade
and elevation severally and respectively specified as above.

The figures above shown are elevations in feet snd
fractions of feet and such elevations and the grades herein referred to have reference to the height above the "base of levels or eleva- tions" for the City of Lodi, which base is a levelflane fifty feet
below the center line of a certain aluminum tablet placed in the West
wall of the Van Buskirk buildi ng, near its Northwest corner, which building is situate at the Southeast corner of Pine and School Streek in said City of Lodi, and which tablet is marked"U. S. Geological SUP
vey B. M.," and which "base of levels or elevationsll was established
and determined, and is further defined, in and by Sec. 5 of Ordinance
No. 67 of said City of Lodi.
The grade of the respective curbs and gutters on each side of said Walnut street, andon each side of said Oak street, shall
be uniform between consecutive points a,t which elevations are, or are
to be fixed, as above mentioned.
Where 8. street or avenue upon which a gutter gzade has
been herein fixed, intersects with another street or avenue, any Wtte
leading from one such street or avenue into the other street or aven- ue shall lie on a uniform grade running from the nearest point in the
street or avenue a.t which an elevation is herein fixed for such gutter to the nearest point on the other street or avenue at which an eleva- tion has been heretofore fixed for the gptter joining same.
Curb gra.des have reference to the elevations of the
top of curb at its outer line, a,ssuming the curb to have sharp corners
Gutter grades have i'eference to the lowest flow line of the water way in the gutter.
Section 11. Curb lines are hereby fixed and establish
ed as hereinafter set forth, and the elevations and grades above spea
ified have reference to the elevations and grade of curbs upon the
lines so fixed.
Upon street crossings and opposite the terminations of
intersecting streets, the intersecting curbs at street corners shall be prolonged and be connected on a curve having a radius of eight
(8) feet, with radial center lying between the curb line and such di-
vision lines, a.nd such proloimgation and curb shall constitute the curb return.
Where a curb line herein is established a.t a certain
distance from a division line between a street and the lQts and block
abutting thereon, such distance is to be taken on the side of such division line towards the center of the street.
Section 111. A curb return is hereby defined to be
that portion of a curb which extends around a street corner and con- nects the curb on one street with the nearest, adjacent curb in an intersecting street. Where an elevation is established as above at the intersection of the curb line with a street line, being one end
of such a curb return such elevation sha.11 be the eleva.tion for the
other end of the curb return at the intersection of the side line of the street with the curb line of th.e intersecting street, and such eleva, tio n shall also prevail throughout the curb return.
Section IY. Gutters shall be adjacent to and on the roadbay side of the curb, exoepting across alleys, where they
will be produced across the alleys.
Section V. All Ordinances, or parts of Ordinances,
in conflict with theprovisions herein are hereby repealed.
"The Lodi Sentinel, It a tri-weekly newspaper published and. circulat- ,
ed in said City of Lodi, and shall take effect and be in force from
and a,ftes its passage and publication.
Section VI. This Ordinance shall be published in
J. D; Cyose.
