Ordinance No. 781 of the City of Lodi entitled "AN ORDINANCE REPEALING ORDINANCE NO. 606 OF THE CITY OF LODI AND ENACTING A NEW ORDINANCE ESTABLISHING RATES FOR THE SALE OF ELECTRIC ENERGY BY THE CITY OF LODI" is hereby repealed as of the effective date of this ordinance. Section 2. Ordinance No. 801 of the City of Lodi entitled "AN ORDINANCE AMENDING ORDINANCE NO. 781 ENTITLED "AN ORDINANCE REPEALING ORDINANCE NO. 606 OF THE CITY OF LODI AND ENACTING A NEW ORDINANCE ESTABLISHING RATES FOR THE SALE OF ELECTRIC ENERGY BY THE CITY OF LODI" AND THEREBY PROVIDING FOR 400-WATT OUT- DOOR DUSK-TO-DAWN LIGHTING RATES" is hereby repealed as of the effective date of this ordinance. Section 3. Ordinance No. 988 of the City of Lodi entitled "AN ORDINANCE AMENDING ORDINANCE NO. 781 OF THE CITY OF LODI AND PROVIDING A NEW RATE SCHEDULE FOR CUSTOMERS WITH DEMANDS OF 1,000 KW OR GREATER" is hereby repealed as of the effective date of this ordinance. Section 4. Schedules "A", "B", "D-A", "D-B", "S-I", "S-11" and "L" are hereby established as hereinafter set forth. Section 5. SCHEDULE A - DOMESTIC SERVICE is applicable to domestic. lighting, heating, cooking and single-phase domestic power service in single- family dwellings and in flats and apartments separately metered by the City; to single-phase service used in common for residential purposes by tenants in multi- family dwellings; and to all single-phase farm service on the premises operated by the person whose residence is supplied through the same meter. The adjustment amount shall be the product of the total kilowatt hours for which the bill is rendered times the adjustment amount per kilo- watt hour. (b) SPECIAL CONDITIONS (i) When a business or commercial establishment is conducted in conjunction with a residence and both are measured through one meter, this rate does not apply. (ii) Service on this schedule will be supplied at the single-phase secondary voltage available - either 120/240 or 120/208 volts. Section 6. SCHEDULE B - GENERAL SERVICE is applicable to single-phase or polyphase alternating current service, or to a combination thereof, provided that all polyphase service to any customer on the same premises shall be supplied through one meter. Service to each of two or more separate areas, but not in the same building, and which do not overlap within the same premises, may be individually metered. Fuel Cost Adjustment: A fuel cost adjustment will be included in each bill for service. The adjustment amount shall be the product of the total kilowatt hours for which the bill is rendered times the adjustment amount per kilowatt hour. -2- (b) SPECIAL CONDITIONS (i) ANNUAL BASIS: For customers who use service for only part of the year, this schedule is applicable only on an annual basis. (ii) VOLTAGE: Service on this schedule will be supplied at the secondary voltage available. or 1201208 volts. Three-phase power service will be 120/208, 240, 2771480 or 480 volts. Combination light and power will be supplied as a four-wire service of 120/240, 1201208 or 2771480 volts. Single phase for lighting will be either 1201240 Section 7. SCHEDULE D- "A" - GENERAL POWER - MAXIMUM DEMAND BASIS is applicable to alternating current used in motors, heating and cooking devices, and rectifiers for battery charging; but is not applicable to current used for lighting, either directly or through transforming or converting equipment, except incidental lighting (as defined in Special Condition (iii) below) combined with power on the same meter. This schedule is applicable only to customers of record on May 1, 1973 who thereafter maintain continuous service at the same location under this schedule. Fuel Cost Adjustment: A fuel cost adjustment will be included in each bill for service. The adjustment amount shall be the product of the total kilowatt hours for which the bill is rendered times the adjustment amount per kilowatt hour. (b) SPECIAL CONDITIONS (i) BILLING DEMAND: For the purpose of this schedule the billing demand is the maximum demand made by the customer's equipment for electrical power during the month for which bill is rendered, but not less than 50% of the highest such demand in the preceding eleven months nor less than the diversified resistance welder load. The maximum demand in any month will be the maximum average power -3- taken during any 15-minute interval in the month; provided, that in cases where the use of energy is intermittent or subject to violent fluctuations, a 5-minute interval may be used. (ii) GUARANTEED LOAD: Any customer may obtain the rates and conditions of service for a billing demand greater than his actual demand by guaranteeing the charges (including the minimum charge) applicable to such greater demand. guaranteed demand may not be changed more than once per year. Such (iii) INCIDENTAL LIGJTCING: For the purpose of this schedule, incidental lighting is any lighting on the premises of an industrial (as distinguished from commercial) plant operated by power supplied on this schedule, except lighting in dwellings or in buildings used primarily for trade or for any purpose not essential to the operation of such plant. (iv) VOLTAGE: Any standard distribution voltage, single or polyphase at the customer's choice, but not more than one will be supplied on this schedule. Section 8. SCHEDULE D- "B" - GENERAL POWER - CONNECTED LOAD BASIS is applicable to alternating current used in motors, heating and cooking devices, and rectifiers for battery charging; but is not applicable to current used for lighting, either directly or through transforming or converting equipment. Per Year $8.00 5.60 Energy Charge (to be added to Demand Charge) : The energy rates applicable to Rate (A) above. -4- I NOTE: The Minimum Charge in Rate (A) and the Demand Charge in Rate (B) shall be based on a connected load of at least 2 hp for single-phase service and at least 3 hp for three-phase service. Fuel Cost Adjustment: A fuel cost adjustment will be included in each bill for service. The adjustment amount shall be the product of the total kilowatt hours for which the bill is rendered times the adjustment amount per kilowatt hour. (C) SPECIAL CONDITIONS (i) CONNECTED LOAD: For the purpose of this schedule, connected load is the sum of the capacities of all of the customer's equipment that may be connected to the City's lines at the same time. (ii) GUARANTEED LOAD: Any customer under Rate (A) may obtain the rates and conditions of service for a connected load larger than his actual connected load by guaranteeing the charges (including the minimum charge) applicable to such larger connected load. per year. Such a guaranteed load may not be changed more than once (iii) VOLTAGE: Any standard distribution voltage, single or poly- phase at the customer's choice, but not more than one will be supplied on this schedule. Section 9. SCHEDULE S-I - GENERAL SERVICE - DEMAND METERED is applicable to single-phase or polyphase alternating current service, or to a combination thereof, provided all polyphase power service to any customer on the same premises shall be supplied through one meter. Service to each of two or more separate areas, but not in the same building, and which do not overlap within the same premises may be individually metered. (The fuel cost adjustment amount is not subject to any adjustment for voltage or power factor.) (b) SPECIAL CONDITIONS (i) MAXIMUM DEMAND: The maximum demand in any month will be the maximum average power taken during any 15-minute interval in the month, but not less than the diversified resistance welder load. However, when the recorded monthly maximum demand has exceeded 400 kw for three consecutive months and thereafter until it has fallen below 300 kw for twelve consecutive months, a 30- minute interval will be used. In cases where the use of energy is intermittent or subject to violent fluctuations, a 5-minute interval may be used. A thermal type of demand meter which does not reset after a definite time interval may be used. (ii) BILLING DEMAND: The billing demand to be used in computing charges will be the mean of the actual maximum demand as determined under Special Condition (i) above for the current month and the highest such demand occurring in the year ending with the current month. (iii) OFF-PEAK DEMANL): Any customer whose billing demand has exceeded 400 kw for 3 consecutive months and thereafter until it has fallen below 300 kw for 12 consecutive months may, upon request, for billing purposes, have demands ignored which occur between 10:30 p.m. and 6:30 a.m. of the following day and on Sundays and the following holidays: Memorial Day, Independence Day, Labor Day, Veterans' Day, Thanksgiving Day and Christmas Day, as said days are specified in Public Law 90-363 (U.S.C.A. Section 6103). New Year's Day, Washington's Birthday, (iv) VOLTAGE: Service on this schedule will be supplied at the secondary voltage available or, at the option of the customer, at the primary voltage available. Where secondary voltage is desired and polyphase power is to be combined with single phase, a four-wire service will be supplied. (v) VOLTAGE DISCOUNT: (1) When delivery hereunder is made at the same voltage as that of the line from which the service is supplied, or (2) when sufficient capacity is not available in distribution facilities existing in the area to supply the customer's requirements, and the City has elected to supply service from a transmission line for its operating convenience by means of City- owned transformers on the customer's property, a discount of 4% will be allowed -6- on the above charges, including the minimum charge, provided, however, the City is not required to supply service at a non-standard voltage. When service is supplied directly without transformation from a transmission line of 60 kv or higher, a discount of 5% will be allowed. its line voltage at any time, after reasonable advance notice to any customer receiving a discount hereunder and affected by such change, and such customer then has the option to change his system so as to receive service at the new line voltage or to accept service (without voltage discount) through transformers to be supplied by the City. The City retains the right to change (vi) POWER FACTOR: When the billing demand has exceeded 400 kw for three consecutive months and thereafter until it has fallen below 300 kw for twelve consecutive months, bills will be adjusted for weighted monthly average power factor as follows: The total charge (except the minimum charge) for any month as computed on the above rates will be decreased or increased, respectively, by 0.1% for each 1% that the average power factor of customer’s load in the month was greater or less than 85%, such average power factor to be computed (to the nearest whole per cent) from the ratio of lagging kilovolt ampere hours to kilowatt hours con- sumed in the month. Section 10. Any customer may obtain the rate and conditions of service existing on this SCHEDULE L - OUTDOOR DUSK-TO-DAWN LIGHTING is applicable to City-owned and maintained outdoor overhead lighting service where street light service schedules do not apply. (a) RATES For each 175-watt Mercury Vapor lamp - $3.50 per month. For each 400-watt Mercury Vapor lamp - $5.70 per month. (b) CHARACTER OF SERVICE Lamps shall be approximately 175-watt or 400-watt Mercury Vapor with luminaire and bracket, as specified by City of Lodi Utility Department, and shall be supported on City-owned poles which are used to carry distribution system circuits for other City purposes and shall be at locations approved by City of Lodi. give approximately 4,000 hours of lighting service annually. Lamps will be controlled to burn from dusk to dawn each night so as to (c) TERRITORY SERVED Within the city limits of Lodi. (d) BILLING PROVISIONS Service rendered under this schedule will be billed monthly or bi- monthly at City's option, in conjunction with an existing metered account (which will appear on City bill as "EL") with no meter readings. -9- (e) LAMP SERVICING AND RELOCATIONS (i) Upon receipt of notice from customer of failure of light to operate as scheduled, the City of Lodi Utility Department will, within a reasonable period of time, make the necessary repairs. (ii) City of Lodi will, at customer's request, relocate existing outdoor lighting service equipment, provided customer reimburses the City for the net expense to City incurred therewith. (iii) Any additional facilities required other than mentioned in character of service shall be at customer's expense.prior to installation. Section 12. URGENCY REVENUE MEASURE. This ordinance is hereby declared to be an urgency measure for the imnediate preservation of the public pease, health and safety, and a measure fixing an amount of money to be raised by taxation, all within the meaning of Section 36937 of the Government Code of the State of California and Article IV, Section 1, of the Constitution of the State of California. The facts concerning such declaration are: (a) The City of Lodi owns and operates an electric distribution system, presently purchasing electric energy in bulk from the Pacific Gas and Electric Company. The contract under which such electrical energy is purchased has been modified by the Federal Power Commission of the United States of America and on April 28, 1973 a new and substantially higher rate will be imposed by the Company. Lack of additional revenue to the City, commencing on the date on which the higher rate is imposed upon the City, will result in a reduction in the governmental and proprietary services furnished the public by the City, to the detriment of the public peace, health and safety. (b) Partial reliance upon electric revenues for the provision of other governmental and proprietary services has made it impracticable to make complete provision for the operation of Municipal facilities in the fiscal year 1972-73 pending determination of electric costs and revenues. Assurance of safe and reasonable service levels requires the adjustment of such costs and revenues at the earliest possible moment. -10- Section 13. EFFECTIVE DATE. The ordinance is being published one time in the "Lodi News Sentinel," a daily newspaper of general circulation printed and published in the city of Lodi and shall be in force and take effect with respect to all electric bills for service furnished on and after May 1, 1973.
