HomeMy WebLinkAboutOrdinances - No. 987ORDINANCE NO. 987 AN ORDINANCE AMENDING SECTION 11-12 OF THE LODI CITY CODE BY ESTABLISHING FEES TO BE PAID BY ALL USERS OF THE HARNEY LANE SANITARY LANDFILL AND AMENDING THE BASIC RATE AND REGULATIONS. The City Council of the City of Lodi does ordain as follows: Section 1. Section 11-12 of the Code of the City of Lodi is hereby repealed and said Section 11-12 is re-enacted to read as hereinafter set forth: Section 11-12. (a) Rules and regulations governing waste disposal grounds. The solid waste disposal grounds at the City sanitary fill shall be used only when the custodian or some other properly designated person is in charge thereof. The grounds shall be open to use from 8:OO a.m. to 4:30 p.m. daily, except on such holidays as may be designated by the city manager. (b) The following charges shall be made to all persons using the solid waste disposal grounds: (1) Persons hauling household garbage, per vehicle ..... $1.00 (2) Persons hauling commercial and industrial waste materials including garbage: a. 0 to 2 cubic yards ............................. 1.00 b. each additional yard or fraction thereof.. .50 ........ (3) Additional charges for special wastes : a. rubber tires, per yard ......................... 2.00 b. stumps and logs (1) 0" to 24" diameter at butt end, each .......... 1. 00 (2) 24" and over diameter at butt end, each.. ..... 3. 00 c. Septic tank waste, per load ...................... 5.00 -1- (4) Those persons holding a valid refuse collector's contract or franchise with City of Lodi or County of San Joaquin .............................. no charge (5) City of Lodi owned vehicles .................. no charge (6) County of San Joaquin owned vehicles .......... no charge (c) The City reserves the right to refuse to accept any materials not suited for disposal by the methods employed in the conduct of these disposal grounds or dangerous to life and health by the nature thereof. Automobile bodies are specifically prohibited. (d) All waste materials presented for disposal shall be placed as directed by the custodian or employees working under him. (e) All vehicles shall remain on the roadway or roadways to the disposal area, unless otherwise directed by the custodian. No vehicle shall be operated at a speed in excess of ten miles per hour while in the disposal grounds. (f) No person shall conduct salvzge operations on the solid waste disposal grounds unless given written permission by the City Manager. (g) No rubbish, waste, garbage or other materials shall be burned. (h) These rules and regulations may be amended, or other regulations added, from time to time by resolution of the city council, and a copy thereof shall be kept posted at or near the main gate to the waste disposal grounds, including all amendments and additions. (i) Violations of these regulations shall constitute a misdemeanor, and on conviction thereof, the violator may be barred from future use of the waste disposal grounds and be punished by a fine of not more than five hundred dollars or by imprisonment in the county jail for not more than sixty days, or by both such fine and imprisonment. -2- Section 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed insofar as such conflict may exist. Section 3. This ordinance shall be published one time in the “Lodi News-Sentinel, ‘I a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval. this 1st day of November, 1972.
