HomeMy WebLinkAboutOrdinances - No. 982ORDINANCE NO. 982 AN ORDINANCE DECLARING THE INTENTION OF THE COUNCIL OF THE CITY OF LODI THAT THE JUDGES OF THE SUPERIOR COURT OF CALIFORNIA, COUNTY OF SAN JOAQUIN, IMPOSE THE MAXIMUM SENTENCE PERMITTED BY LAW UPON THOSE PERSONS WHO, WITHIN THE CITY OF LODI, SELL, POSSESS FOR SALE, TRANSPORT, ADMINISTER, GIVE AWAY OR ATTEMPT TO SELL, TRANSPORT, ADMINISTER OR GIVE AWAY, MARIJUANA, NARCOTICS OR RESTRICTED DANGEROUS DRUGS. THE PEOPLE OF THE CITY OF LODI DO ORDAIN AS FOLLOWS: Section 1. Definitions. For the purpose of this Chapter, certain terms, phrases and words are defined as follows: (1) "Restricted dangerous drugs" as used herein means any hypnotic drug, amphetamine, lysergic acid, etc. as defined in Section 1190 1 of the Health & Safety Code of the State of California. "Narcotics" as used herein means any of those categories of narcotics defined in Section 11001 of the Health & Safety Code of the State of California. (24 Section 2. 'The public health, interest, and safety of the people of the City of Lodi require, and it is the intention of the Council of the City of Lodi that the Judges of the Superior Court of California, County of San Joaquin, impose the maximum sentence permitted by law upon all persons convicted of violating the provisions of the Health & Safety Code of the State of California pertaining to the possession for sale, transportation, sale, furnishing, administering or giving away of marijuana, narcotics or restricted dangerous drugs, to wit: (1) Section 11500. 5 (2) Section 11501 (3) Section 11502 (4) Section 11502. 1 - 1- (5) Section 11503 (6) Section 11530.5 (7)~ Section 11531 (8) Section 11532 (9) Section 11557 (10) Section 11911 (11) Section 11912 (12) Section 119 13 (13) Section 11917 Section 3. The public health, interest and safety of the people of the City of Lodi further require, and it is the intention of the Council of the City of Lodi that the Judges,of the Superior Court of California, County of San Joaquin, not permit either probation or a reduction of sentence or a reduction of charges for persons accused or convicted of violating those sections of the Health & Safety Code of the State of California enumerated in Section 2 above. 1972.
