HomeMy WebLinkAboutAgenda Report - July 22, 1997COUNCIL COMMUNICATION FOAL AGENDA TITLE: Approve Agreement Between Lodi Unified School District (LUSD) and the City of Lodi for Joint Use of Facilities for Proposed Lawrence Elementary School Multi - Purpose Room MEETING DATE: July 22, 1997 PREPARED BY: Deputy City Manager RECOMMENDED ACTION: That the City Council approve the Attached Agreement (Exhibit A) between LUSD and the City of Lodi to be included in LUSD's grant application for a proposed multi-purpose room at Lawrence Elementary School. BACKGROUND INFORMATION: The Lodi Unified School District (LUSD) is eligible for up to $1 million in State grant monies for the construction of a multi-purpose room on LUSD property. The grant application is due on August 5, 1997. As part of the eligibility criteria, LUSD must have local matching funds and must demonstrate that a public agency will partner for a joint -use project. LUSD representatives have identified the local matching funds and are requesting that the City partner with LUSD in seeking the grant. In the event LUSD receives the grant, the City would have access to the multi-purpose room for the following uses: • Arts and Cultural Programs • Basketball • Volleyball • Indoor Soccer/Hockey • Specialty Classes • Dance and Exercise Classes • Public Meetings • After School Programs The LUSD Board of Education has approved a Resolution (See Exhibit B) authorizing their staff to file the application for the joint use facility at Lawrence Elementary School. LUSD representatives will attend the Special City Council Meeting to present the topic. Dixon Flynn -- City Manager LAWRENCE SCHOOL MULTIPURPOSE ROOM JOINT USE AGREEMENT This Agreement, dated July 29, 1997, between the City of Lodi (City) and the Lodi Unified School District (District) is for the joint planning and use of a new multipurpose room (project) to be located at Lawrence School in the City of Lodi. Recitals 1. There is an ever-increasing demand for indoor recreational space within the City of Lodi. 2. The City and District have long-standing policies and arrangements which foster and implement extended community use of school facilities. 3. The District's program for elementary -level multipurpose rooms does not include indoor sports such as basketball; therefore, the effectiveness of these rooms at existing elementary schools for after-school and evening recreational programs is limited. 4. City and District representatives have been jointly planning a new school to be located on the Richards Ranch site, including a multipurpose room that can adequately accommodate a variety of activities sponsored by the City and community. Planning and implementation of this joint project was thwarted with the failure of the District's Measure U school facilities bond. 5. A multipurpose room at Lawrence School has been a District priority. The school and neighborhood will benefit greatly from a facility that is planned, designed and constructed with a focus on joint school/community use. The program elements identified in the planning process for Richards Ranch are intended to be transferable to other new elementary facilities in the City of Lodi. 6. It is the policy of the District to actively pursue all available sources of funding that will positively advance District facility plans, especially those sources which facilitate maximum public benefits. Agreement The City and District agree as follows: City shall support the District in its efforts to plan, design, finance and build the project. b. The project shall be programmed and designed jointly by representatives from the City and District to accommodate active indoor recreational activities such as, but not limited to, basketball, volleyball, indoor "soft" soccer and hockey, group exercise, dance and similar activities. The project shall also be planned to facilitate after school childcare programs and activities, and group meetings. C. The size and design of the project shall meet all school program needs, and identified community/City needs to the maximum extent within the constraints of the funding source and/or pertinent state requirements. Page 1 of 2 d. The District shall strive to make the project available for community use to the maximum extent possible without hindering school programs and functions. Scheduling of activities, and related facility use costs, shall be consistent with the District Facility Use program in effect at the time of the request. At m time shall authorization for appropriate community use of the project be unreasonably withheld. e. The District will seek state (or other) funds and meet the matching fund requirements. The District will also complete all application forms and assume responsibility for managing the funding application process. f. The City, only by subsequent specific Council approval, shall finance any additional improvements or space which they request be made part of the project which is over and above that which is funded by the District, including the financing sources obtained by District. g. The City will fund all minor equipment and modifications (such as floor sleeves for volleyball and upgraded basketball hoops) which are not dictated by the school's program. h . The City shall assist the District in siting the project on the Lawrence campus, and permit use of adjoining City property for parking, access, and related uses as recommended by City staff. i . The District shall employ the project architect, inspector, construction contractors and related entities, and administer both the design and construction processes. City shall assist as jointly deemed appropriate by District and City personnel. j. The ownership, administration, management, maintenance, and operation of the facility shall be the responsibility of the District. k. This agreement may be terminated by either party. At the time of termination, any fixed improvements provided by City will remain with the District, unless otherwise agreed upon by both parties. Reimche City Clerk Page 2 of 2 BEFORE THE BOARD OF EDUCATION OF THE 9@49:tDB LODI UNIFIED SCHOOL DISTRICT OF THE COUNTY OF SAN JOAQUIN, STATE OF CALIFORNIA RESOLUTION 97-48 AUTHORIZING THE FILING OF APPLICATION FOR APPORTIONMENT AND OTHER REQUIRED DOCUMENTS FOR JOINT USE FACILITY (LAWRENCE ELEMENTARY SCHOOL) WHEREAS, it has been determined that the shared used of the Children's Center multi-purpose building does not adequately serve the needs of the students and community in the Lawrence School area; and WHEREAS. the State Allocation Board has allocated $25 million dollars from Proposition 203 to fund joint -use projects; and WHEREAS, the City of Lodi and the Lodi Unified School District have an agreement for use of school facilities and both entities have joint -use policies in place at this time which would meet the District's self -certification requirements; and WHEREAS, the District's Capital Improvement Plan 2000 adopted by the Governing Board in on June 13, 1989 and revised in 1994 and 1995 specifically identifies the need for the addition of a multi-purpose/library building. NOW, THEREFORE, BE IT RESOLVED that the Board of Education hereby authorizes the filing of an Application for Apportionment with the State Allocation Board for joint -use facility (multi-purpose building) at Lawrence Elementary School; and BE IT FURTHER RESOLVED that the District's Assistant Superintendent, Facilities and Planning Mary Joan Starr, or the Assistant Superintendent, Business Marilyn Domingo, or the Construction Project Manager David Schlueter, or the Superintendent Del Alberti, are hereby directed and authorized to execute all required documents on behalf of the Lodi Unified School District, including amendment to joint -use agreement(s) with the City of Lodi; and BE IT FURTHER RESOLVED that in the interest of time, staff is authorized and directed to administratively select an architect for the design of multi-purpose building at Lawrence Elementary School; and BE IT FURTHER RESOLVED that in the event the District's application under the State Joint -Use Program is not funded, staff is authorized to file an application with the State Allocation Board for funding under the Minimum Essential Facilities program.
