HomeMy WebLinkAboutOrdinances - No. 943ORDINANCE NO. 943 AN ORDINANCE AMENDING CHAPTER 27 OF THE CODE OF THE CITY OF LODI THEREBY ADDING SECTION 27- 12C ENTITLED, "FLOODPLAIN DISTRICT. I' The City Council of the City of Lodi does ordain as follows: Section 1. Chapter 27 of the Code of the City of Lodi is hereby amended to add Section 27-12C to read in full as follows: SECTION 27- 12C. FP FLOODPLAIN DISTRICT. a. Scope and Intent: Code of the City of Lodi is intended to establish specific This amendment to Chapter 27 of the restrictions on the use of those properties or portions of properties which are situated both ivithin the Planning Area of the City of Lodi and within the Mokelumne River Floodplain as defined below. Special regulation is necessary for the protection of the public health, safety and general welfare, and of property and improve- ments both within and without the floodplain from hazards and damage resulting from flood waters. b. Floodplain Boundaries: The Mokelumne River Floodplain is defined as that area adjacent to the normal river channel which could be expected to be innundated by an Intermediate Regional Flood, said area and flood having been defined by the United States Army Corps of Engineers for the City of Lodi in August, 1970. Maps and data which reflect this delineation are on file in the office of the Secretary of the Planning Commission of the City of Lodi. - 1- c. FP District. 1. All areas within the boundaries of the Intermediate Regional Floodplain which are also within the City of Lodi are hereby rezoned to the FP (Floodplain) District. All areas not within the City of Lodi but within the 2. boundaries of the Intermediate Regional Floodplain, and which are also within the City of Lodi Planning Area as shown on the Lodi General Plan are hereby prezoned to the FP (Floodplain) District. d. Uses Permitted. 1. The following uses are permitted without a Use Permit: (i) Agricultural. a. Open space agricultural uses not requiring a closed building such as cropland, orchards, and livestock feeding and grazing. b. The storage of farm machinery. (ii) Recreational. a. Firmly-anchored recreational floating docks. 2. The following uses may be permitted after approval by The Reclamation Board of the State of California and after approval of a conditional Use Permit by the City of Lodi, provided that, as determined by said Reclamation Board, a combination of such uses in a specific reach of the stream does not materially increase the flood height of the Intermediate Regional Floodplain. (i) Occupied or unoccupied travel trailers in an approved travel trailer park or in the travel trailer portion of an approved mobilehome park. -2- a. A travel trailer is defined as any vehicle which at no time exceeds eight (8) feet in width at its widest point and forty (40) feet in length at its longest point, is designed or used for human habitation, whether self- propelled or drawn by a motor vehicle, is intended for permanent or semi-permanent use, and whkh has no foundation other than wheels and temporary stabilizing units. (ii) Outdoor private recreational facilities. a. Campgrounds. b. Boating Facilities. c. Parks. d. e. Athletic Fields. f. Tennis Courts. g. Shooting Range. Golf Course or Driving Range. (iii) Fences, fills, walls, or other appurtenances which do not constitute an obstruction or debris -catching obstacle to the passage of floodwaters. (iv) Private drives, bridges, and public utility wires and pipelines for transmission and distribution. (v) Improvements in stream channel alignment, cross- section and capacity. -3- (vi) Structures that are designed to have a minimum effect upon the flow of water and are firmly anchored to prevent the structure from flotation, (excepting floating docks) provided no structures for human habitation shall be permitted. Other similar uses of a type not appreciably damaged by floodwaters. (vii) e. State Board of Reclamation: All proposed structures or alterations in the Intermediate Regional Floodplain shall be subject to the approval of the Reclamation Board. Lodi City Planning Commission will not approve or recom- mend for approval by another public agency any structure or alterations in the Intermediate Regional Floodplain until an application has been submitted and approved by the Reclamation Board. The Section 2, The alterations, changes and amendments of said Official District Map of the City of Lodi herein set forth have been approved by the City Planning Commission and by the City Counc'il of this City after public hearings held in conformance with the provisions of Chapter 27 of the Code of the City of Lodi and the laws of the State of California applicable hereto. Section 3. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. Section 4. This ordinance shall be published one time in the "Lodi News:Sentinel, I' a daily newspaper of general circulation printed and Appsved this 3rd day of March, 1971. -4- State of California, County of San Joaquin, ss.
