HomeMy WebLinkAboutOrdinances - No. 941ORDINANCE NO. 941 AN ORDINANCE OF THE CITY OF LODI PROHIBITING TRESPASSING OR LOITERING ON OR NEAR POSTED PROPERTY. The City Council of the City of Lodi does ordain as follows: Section 1. Words and Phrases Defindd. For the purpose of this Division certain words and phrases and their derivatives shall be construed as specified in this section. A. Posted Property. The phrase "Posted Property" means any property specified in Section 2 which is posted in the manner provided in Section 3. B. Sign. The word "Sign" means a board, placard or card not less than 1 square foot in area and upon which, in lettering not less than 2 inches in height, appear the words "Trespass ing-Loitering Forbidden by Law, and any time limit that may be specified thereon. Property Subject to Posting. Section 2. Any property within the City of Lodi may be posted against trespassing and loitering in the manner provided in Section 3, and thereby become posted property subject to the provisions of this division. The provisions hereof shall not apply to the following property: 1. An established and existing right of way for public road purposes; or 2. Any property which comes within the provisions of Section 554 of the Penal Code of the State of California. Section 3. Method of Posting. Property may be posted against trespassing and loitering in the following manner: -1- 1. exceeding 300 feet, by posting signs at each corner of the area and at intervals not exceeding 100 feet, and, if such property has a definite entrance of entrances, at each such entrance. If the property does not contain any lineal dimension 2. If the property has lineal dimensions exceeding 300 feet, by posting signs at each corner of the area and at intervals not exceeding 200 feet, and, if such property has a definite entrance or entrances, at each such entrance. Section 4. Trespassing Prohibited. It shall be unlaWfu1 for any person to enter or remain on any posted property without the written permission of the owners, tenant, or the occupant in legal possession or control thereof. Section 5. Exemption - Peace Officers, etc. The provisions of this Division shall not apply to the entry upon posted property in the course of duty of any peace officer or other duly authorized public employee. Section 6. The provisions of this Division shall not apply to any lawful Exemption - Union Activities. , activity by which the public is informed of the existence of an alleged labor dispute. Section 7. Destruction of Signs - Unlawful. It shall be unlawful for any person without authority to tear down, deface or destroy any sign posted pursuant to this Division. Section 8. Stopping, Standing, Parking, Prohibited. It shall be unlawful for the operator of any vehicle to stop, stand, park or leave standing such vehicle at any time within or upon any posted -2- property without written permission of the owner, tenant, or the occupant in legal possession or control thereof. Section 9.. All ordinances and parts of ordinances in conflict herewith are hereby repealed insofar as such conflict may exist. Section 10. This Ordinance shall be published one time in the “Lodi News Sentinel, II a daily newspaper of general circulation printed and published in the City of Lodi, and shall be in force and take effect thirty days from and after its passage and approval.
