The Board of Trustees of the City of Lodi do ordain as follows: Section 1.- Any persons violating, or wilfully non-comply- ing with, any of the provisions of any ordinance of this city is guilty of a misdemeanor, and shall, where no other penalty is specially provided, be punished by a fine not exceeding three hundred dollars, or by imprisonment not ex- , I ceeding three months, or by both such fine and imprisonment ' Refusing to Labor. Lawful &g.e s s i 0 ns not to be Disturbed Section 2.- Any person serving or undergoing a term of imprisonment in the city prison under a judgment of im- prisonment, or under-an alternative judgment of fine and imprisonment and adjudged to labor on the Chain-gang, who refuses to perform Such labor is guilty of a misdemeanor. The Marshal ib hereby empowered to feed any refactory .prisoner or prisoners so refusing on a diet of bread and water during such time as such prisoner or prisoners may continue. so to refuse to perform such labor. Section 3.- Any person who shall within the City of Lodi, without authority of law, disturb, disquiet, or interrupt, 1- Any school or school procession; 2- Any funeral or funeral procession;- 3- Any lawful procession or assemblage of people met for lawful purposes;: is guilty of a misdemeanor. Disturbances in general. Section 4.- Every person who shall disturb the peace or good order of this city, by violent threats, loud or unusual .noises , quarreling, traducing , chaliengi ng to fight , fighting or drunkeness, or display with malicious intent any deadly weapon or weapons, or by violent threats or abusive language, tend to provoke a breach of the peace, or who shall be found in an intoxicated or drunken condition upon any street, thoroughfare, alley sidewalk or grounds, Vulgar and Abusive Language. Disorder, etc. or in or upon any-premises within the corporate limits of the city, is guilty of a misdemeanor. Section 6.- Any person who shall in any public street or place within the city limits within the hearing of two or more persons, make use of any bawdy, lewd, obscene or profane language, words, gestures or epithets, is guilty of a misdemeanor. Section 6.- Any person who shall make in any place or suffer to be made on his premises or upon premises under his control any disorder or tumult to the disturbance of the public peace, is guilty of a misdemeanor. Fast Driving. Section 7.- Any person, except a public officer in the dis- charge ofhis duties, who shall ride or drive any animal through any street, alley, or public way in the inhabited portion of the city at any rate of speed greater than eight miles an hour, and any driver of any animal or team who shall driw over any crossing or sCreet walk, used as a street crossing for pedestrians at any rate of speed faster 4 than a walk, or who shall in any way obstruct, impede, or impair the reasonable exercise of a paramount right-of way by any pedestrians on such street or cross walk, is guilty of a misdemeanor. But the right of way for &&E apparatus of the fire department when going forth upon an alarm to a fire or a supposed fire shall be paramount to that of pedestrians upon cross walks. & Riding on K Sidewalks. Section 8.- Any person who shall ride, drive, lead, place or tie any horse or other animal on any sidewalk of this city, except when preceding% directly across such walk, or who shall allow his horse, mule, wagon, or other vehicle to stand upon the crossing of any street walk, is guilty of a misdemeanor. #caving Iokses hhi t ched. unning icycles on idewalks. Section 9.- Any person who shall leave standing in any of the streets, alleys, or highways of this city, any horse or work animal attached or hitched to any wagon, cart, buggy or other vehicle, unless attended by some person of suitable age or discretion, or hitched in a good and substantial manner is guilty of a misdemeanor. The provisions of this section shall not apply to persons carrying on the business or occupation of selling and furnishing regularly to the citizens of the city, meats, vegetables, bread, ice,-beer, milk, or other commodities whilst actually engaged in the delivery thereof, or to licensed draymen. Section 10.- Any person, excepting invalids or children of six years of age or under who shall ride or propel any coaster, bicycle, or trycycle, or skate with roller 'skates upon any sidewalk within the City of Lodi is guilty of a misdemeanor. Section 11.- Any person who shall carelessly or negligent- ly ride or drive any bicycle, motor cycle, or motor vehicle or vehicle or machine of similar character upon any public street or alley..in the city, or who shall in any such street or alley ride or drive any bicycle, motor cycle, or motor vehicle, or vehicle or machine of any character at a rate of speed faster thalb eight miles per hour is guilty of a misdemeanor. Section 12.- Any person who shall appear in any public place or street in an indecent or lewd dress or to be guilty of any lewd or indecent behavior, or who shall solicit by words, gestures, or otherwise any.person passing or being on the public street or place to-enter any house for lewd purposes is guilty of a misdemeanor. Carrying Concealed Weapons Wilful In jury to Buildings. Tramlr: , Begging. Section 13.- Any persons excepting public officers and travelers, who shall wear or carry concealed AtaXgawS upon his person any pistol or firearm, slung-shot, dirk or bowie knife, or other deadly weapon, without a written pedmission (revocable at any time) from the City Marshal is guilty of a misdemeanor. The Marshal is hereby empowered to grant written permission to any peacable person whose profession or occu- pation may require him to be out at late hours of the night, to carry concealed weapons, for his own protection. Such persons and no others shall be deemed travelers within the meaning of this section, as may be engaged in making a journey at the time to or from the town, city, or county of his residence. Section 14.- Every person who wilfully or maliciously breaks or destroys any window, window sash, door, blings, or pane of glass of any house, or out house in the city, or commits any nuisance therein or breaks or destroys or in- jures any thing therein, 01" any part of such house, outhouse, or any fence or improvement, is guilty of a-misdemeanor. Section 15.- Any person who shall visit any house within the city for the purpose of soliciting food or clothing, or alms, or who shall in any public place in the city solicit alms or money or charitable assistance from any person to whom he is a stranger or to whom he is unknown, unless he first pmmn obtains a permit from the Marshal so to do, is guilty of a misdemeanor. Provided, that this section shall not apply to the acts of members of any association or society existing in this city for benevolent or charitable purposes; or for mrass$x;w$ the purpose of assisting or aiding any church or like msgkaa C%?@:WBL organization. Noises in Public Hal Is, etc. Section 16,- Any person who shall make any loud and boisterous noises, whistles or otherwise disturb the good qoises in Saloons. Children Visiting Saloons. order in any public hall, theater or other place of enter- tainment in tk city during a performance, lecture, or entertainment of any kind, is guilty of a misdemeanor. Section 17.- Any person 0s persons engaged in the business of keeping, maintaining, or carrying on or conducting with- in the limits of the city any saloon, bar or bar-room where spiritous, vinous, malt,\mixed or intoxicating liquors are sold or given away, or his or their agents, servants or employes who shall make, create or produce, or cause orL. permit or allow to be made, created or produced in such saloon, bar or bar-room any loud or -2 unseemly or vulgar or offensive noises or disturbances either by talking, singing or carousing or in any other manner or form; or to use or play or to cause or permit or suffer or allow to be used or played therein any musical instrument of whatever nature or kind is guilty of a misdemeanor. Any-act in violation of this section shall be con- strued to be a separate offense for each day on which such act shall occur. Section 18.- Any person under the age of 18 years who shall visit any saloon or other place where liquors are sold or retailed, or frequent any improper place or resort is ~- --- . - - ._ Defacing Signs, etc. Section 27.--Any person who shall tear down, mutilate, re- move, deface or destroy any notice, handbill ar sign of any business or performance of any kind, or any ornamental Si@ on awn'ing posts or any 'news or bulletin boards, or who shall use such board for posting any notice, device, ., . -2 %Lc Section 31.- This ordinance shall be published by,pos ing the same in three public places in the City of Lodi. Section 32.- This ordinance shall take effect immediately upon approval and publication. Section 33.- X& All ordinances and parts of ordinances in conflict herewith are hereby repealed.
