HomeMy WebLinkAboutOrdinances - No. 884ORDINANCE NO. 884 AN ORDINANCE ADOPTING THE "UNIFORM FIRE CODE, 1967 REVISION" PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION, VIDING OFFICERS THEREFOR AND DEFINING THEIR POWERS AND DUTIES. AND ESTABLISHING A BUREAU OF FIRE PREVENTION AND PRO- WHEREAS, the City Council of the City of Lcdi did on the 15th day of January, 1969 read the title of the above entitled ordinance and did thereupon schedule a public hearing thereon for February 5, 1969 at the hour of 8:OO o'clock p.m. of said day in the Council Chambers of the City Hall, Lodi, California, in accordance with the provisions of Section 50022.3 of the Government Code; and WHEREAS, notice of the hearing was published twice in a news- paper of general circulation in accordance with the provisions of Section 6066 of the Government Code as appears by the Affidavit of Publication on file herein; and WHEREAS, at the time set for hearing no protests were received by the City Council; Be it ordained by the City Council of the City of Lodi as follows: Section 1. Sections 10-1 to 10-2 and 10-3 of the Code of the City of Lodi, are hereby repealed and the same are hereby superceded and replaced by new Sections 10-1 to 10-10 to read as hereinafter set forth: Section 2. There are hereby adopted new Sections 10-1 to 10-10 of theGode of the City of Lodi, 1959 to read in full as follows: Section 10-1. Adoption. There is hereby adopted by the City of Lodi, for the purpose of prescribing regulations governing conditons hazardous to life and property from fire or explosion, that certain code known as the Uniform Fire Code recommended by the California Fire -1- Chief's Association, being particularly the 1967 edition thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended (by Section 6 of this ordinance), of which code not less than three (3) copies have been and are now filed in the office of the Clerk of the City of Lodi and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of Lodi. Section 10-2. Establishment and duties of Bureau of Fire Prevention. a. The Uniform Fire Code shall be enbrced by the Bureau of Fire Prevention in the Fire Department of the City of Lodi which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. Section 10-3. Definitions. a. Wherever the word "Municipality" is used in the Uniform Fire Code, it shall be held to mean the City of Lodi. b. Wherever the term "Corporation Counsel" is used in the Uniform Fire Code, it shall be held to mean the attorney for the City of Lodi. Section 10-4. Establishment of limits of districts in which storage of flammable or combustible liquids in outside above ground tanks is to be prohibited. a. The limits referred to in Section 15.201 of the Uniform Fire Code in which storage of flammable or combustible liquids in outside above ground tanks is prohibited is the entire City of Lodi except in areas zoned C-2, C-M, M-1 and M-2 as said zones are defined in the Zoning Ordinance -2- of the City of Lodi. b. The limits referred to in Section 15.401 of the Uniform Fire Code, in which new bulk plants for flammable or combustible liquids are prohibited is the entire City of Lodi except in areas zoned C-2 CM, M-1 and M-2 as said zones are defined in the Zoning Ordinance of the City of Lodi. Section 10-5. Establishment of Limits in which bulk storage of liquefied petroleum gases is to be restricted. The limits referred to in Section 20.05a of the Uniform Fire Code, in which bulk storage of liquefied petroleum gas is restricted, is the entire City of Lodi except in areas zoned CM, M-1 and M-2 as said zones are defined in the Zoning Ordinance of the City of Lodi. Section 10-6. Establishment of limits of districts in which storage of explosives and blasting agents is to be prohibited. The limits referred to in Section 41-06-b of the Uniform Fire Code, in which storage of explosives and blasting agents is prohibited, are hereby established as follows: the entire City of Lodi except in areas zoned CM, M-1 and M-2 as said zones are defined in the Zoning Ordinance of the City of Lodi. Section 10-7. Amendments made in the Uniform Fire Code. The Uniform Fire Code is amended and changed in the following respects: Section 1.50 I. of said Uniform Fire Code is hereby amended to read as follows: Incinerator shall mean a building, or portion thereof, container, device or other appliance designed, used or intended to be used for the disposal of combustible rubbish by burning. -3- Incinerator, Class I shall mean any incinerator whether free standing or an integral part of a building and built in accordance with Lodi adopted Uniform Building Code, or any Uniform Building Code adopted thereunder. Incinerator, Class I1 shall mean an incinerator constructed of brick, cement, hollow tile or of metal of not less than #7 U. S. Standard Gauge, with a completely enclosed com- bustion chamber and shall be equipped with a permanently attached spark arrester. Incinerator, Class 111 shall mean an incinerator, con- structed of substantial metal, drum type, with suitable provision for draft and with an attached screen or perforated top. Openings shall not be larger than one-half (1/2) inch. Section 27.14 of said Uniform Fire Code is hereby amended to read as follows: Section 27.14 Types and Construction of Incinerators. a. Every incinerator used in the City of Lodi shall, comply with the provisions of this section. b. Class I, I1 and I11 incinerators shall be constructed in accordance with the definitions contained in section 1.50 of the Uniform Fire Code, as amended. c. Every Class I or I1 incinerator shall be equipped and main- tained with a spark arrester constructed of iron, heavy wire mesh, or other noncombustible material, with openings not larger than one half (1/2) inch. d. Class 111 incinerators are approved for single family occupancy use only. e. Every incinerator constructed or used from this day forward shall meet the minimum requirements of the Air Pollution Control District -4- having jurisdiction provided such district has been formed. Section 27.15 of said Uniform Fire Code is hereby amended to read as follows: Section 27.15 Location1 ( a) No person shall locate, maintain or use any Class I1 or Class 111 incinerator, or outdoor fireplace within five feet of any building or structure or within ten feet of any opening in any building or structure except that within the approval of the Chief, such incinerator may be not less than one foot from any building or structure if equipped with an approved chimney extending from at least two feet above the incinerator or fireplace with an iron or steel stack of not less than 24gauge securely attached to the chimney and supported by a metal strap anchored to the building wall and extending at least three feet above the highest portion of the highest building wall or roof within ten feet of the stack. (b) This restriction shall not apply to outdoor fireplaces built in accordance with Chapter 37 of the Uniform Building Code, which contains requirements for chimneys and fireplaces. Section 10-8 . Appeals. Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the City Manager within 30 days from the date of the decision appealed. Section 10-9. New materials, processes or occupancies which may require permits. The City Manager, the Chief of the Fire Department and Chief of the Bureau of Fire Prevention shall act; as a committee to -5- to determine and specify after giving affected persons an opportunity to be heard, any new materials, processes or occupancies, which shall require permits, in addition to those now enumerated in said code. The Chief of the Bureau of Fire Prevention shall post such list in a conspicuous place in his office, and distribute copies thereof to interested persons. Section 10-10. Penalties. Section 1.17 of the Lodi City Code, 1959 shall be applicable for any and all variances of the provisions of this chapter. Section 10-11. This ordinance shall be published once a week for two successive weeks in the Lodi News-Sentinal, a newspaper of general circulation printed and published in the City of Lodi, and shall be,& force and take effect thirty days after its passage.
