HomeMy WebLinkAboutOrdinances - No. 88Section 3:- That Section 11 of Ordinance Number 21 be, and is hereby amended to read as follows:- .he r 'at An Ordinance of the City of Lodi Amending Ordinance NumbEr 21 Relating to the Fire Department of the City of Lodi. \ The Board of Trustees of the City of Lodi do ordain as follows: Section 1:- That Section 4 of Ordinance Number 21 be, and is hereby mended to read as follows:- Section 4:- Any person interfering with the chief of the fire department, his assistants or any fireman or fire marshal while in the lawful performance of their duty, or who refuses or neglects to obey all lawful orders or requirements of the chief or his assistants is guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not more than $50.00 or by imprisonment in the city or county prison for not more than ten days, or Jy both such fine and impri sonmen t . A11 engines, hose and other movable apparatus belonging to the Fire Department, and the Chief of the Fire Department, shall have paramount right of way through all streets, alleys ad places in the City of Lodi, when going to any fire, and all persons must give the fire department and every part thereof the unobstructed use of the street whev going to any fire; upon the approach of any apparatus of the Fire' Department, every person riding, driving , propelling or in charge of any vehicle in or upon any street in the City of Lodi, shall immediately stop such vehicle as near as possible to the right-hand curb of such street, and it shall be unlawful for any such person to cause or permit such vehicle to be moved until such apparatus shall have passed such vehicle/ or reached a point 400 feet in ad-vance thereof, nor to the rear, shall my vehicle approach nearer than 400 feet in the rear of any such apparatus, unless such vehicle/being used in conveying firemen to the fire, until the same has completed its run. is Section 2:- That Section 7 of Ordinance Iiumber 21 be, and is hereby amended to read as fallows:- Section 7:- All aisles and passage-ways in buildings used for .. public assenblages shall be free from camp stools, chairs, benches, sofas, or other obstructions during any peri'ormmce, service, exhibition, lecture, cancert, ball, or other public assemblage whatever, and the chief and assistant chief of the fire department, and fire marshals, shall have free access to any building during such assemblage, performance, service ,exhibition, lecture, concert, ball or other publaic assemblage. Section 3:- That Sect ion 11 of Ordinance Number 21 be, and is hereby amended to read as follows:- Section $1:- The Chief of the Fire Department shall, at least once each month, inspect the city for the purpose of ascertaining whether the fire ordinances are being violated, and whether there exists any rubbish or combustible material likely to become ignited and cause fire, and for that purpose he shall have authority to enter. any lot, premises, building or structure within said city, and if, upon such inspection, said Chief finds my fire ordinance being violated, he shall immediately report same to the City iviarshal; if he finds any rubbish or combustible material likely to become ignited and cause fire, he shall immediately notify the owner or occupant of any such lot, premises, building or structure on or in vdiich the same is situated to immediately remove such rubbish or combustible material, and if such owner or occupant fails to remove such rubbish or combustible material within two days after receiving such notice, the Chief of said Fire Dppartment shall cause the same to be removed, and the expense incurred in the removal thereof shall be a charge against the omex or occupant of said premises, and il the sam is not paid upon demand, said Chief shall institute suit in the name of the City of Lodi to collect the same, together mith a penalty of $10.00 and when collected to be paid into the General Fund of said City. Section 4:: That four new sections be added to said Grdinance, numbered 4k, 59, 6* and 7Q, to read as follows:- Section 4*:- It shall be unlawful within the City of Lodi, to drive an automobile, auto-truck, motorcycle, or any other vehicle, or any 2. horse or other animal over any fire hose or any other equipment belonging to the Fire Department while in the streets, alleys or any place in the City of Lodi. Section 5Q:- KO person, except by permission and under authority of the Chief of the fire deparhment, shall enter any burning building after the lire department has arrived at such building; when it is so ordered by the Chief of the Fire Department or his Assistants or the Fire bla-Cshals, all persons must move to a distance not less than 50 feet from such building and to a distance of not less than 25 feet from any apparatus of the fire de2artment while engzged in putting out any fire. Chief or his assistants, annd when their services are so Section 5:- This Ordinance shall be published one time in The Lodi Sentinel, a newspaper of general circulation printed and pub- lished in the City of Lodi, and shall take effect thirty days after its passage, appioval and publication.
