HomeMy WebLinkAboutOrdinances - No. 879ORDINANCE NO. 879 I AN ORDINANCE ADOPTING THE "INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS UNIFORM PLUMBING CODE, 1967 EDITION, " PROVIDING FOR THE ESTABLISHING OF MINIMUM REGULATIONS FOR THE INSTALLATION, ALTERATION OR REPAIR OF PLUMBING AND DRAINAGE SYSTEMS AND THE INSPECTION THEREOC PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. SECTIONS 18.1 TO 18 4 4 INCLUSIVE OF THE CODE OF THE CITY OF LODI WHEREAS, the City Council of the City of Lod did on the 18th day of December, 1968, read the title of the above entitled ordinance and did thereupon schedule a pub1 ic hearing thereon for January 15, 1969, at the hour of 8:OO o'clock p.m. of said day in the Council Chambers of the City Hall, Lodi, California, in accordance with the provisions of Section 50022.3 of the Government Code; and WHEREAS, notice of the hearing was published twice in a newspaper of general circulation in accordance with the provisions of Section 6066 of the Government Code as appears by the Affidavit of Publication on file herein; and WHEREAS, at the time set for hearing no protests were received by the City Council; NOW, THEREFORE, the City Council of the City of Lodi does ordain as follows: Section 1. Sections 18.1 to 18.4 inclusive of the Code of the City of Lodi are hereby repealed and the same are superseded and replaced by new Sections 18.1, 18.2, 18.3 and 18.4 to read as hereinafter set forth. Section 2. There is hereby adopted a new Section 18.1 of the Code of the City of Lodi to read in full as follows: Sec. 18.1. Adopted, filing; application. The International Association of Plumbing and Mechanical Officials Uniform Plumbing Code, 1967 Edition, hereinafter referred to as "Uniform Plumbing Code, " -1- plus the appendix, is hereby adopted by reference and th6 provisions of the Uniform Plumbing Code, 1967 Edition, shall obtain and apply to all matters apper- taining to plumbing and gas fittings in the City, save and except the additions, deletions and changes thereto as set forth in the following section. Section 3. There is hereby adopted a new Section 13.2 of the Code of the City of Lodi to read in full as follows: Sec. 18-2. Additions, deIetions and changes. The Plumbing Code adopted by the preceding section shall be subject to the following additions, deletions and changes: (a) Delete Section 1.1 (b) Delete Section 1.2 (c) Change Section 1.3 . Department having Jurisdiction to read: The Building Division of the Department of Public Works and the Chief Building Inspector or his authorized representative shall enforce the provisions of this ordinance and shall have all of the duties and rights of the Administrative Authority as provided in the Uniform Plumbing Code, 1967 Edition, as herein amended. (d) Delete Section 1.4. (e) Delete Section 1.7. (f) Change Section 1.10 by deleting paragraph (a) and relettering paragraph (b) to (a) and (c) to (b). (g) Add to the blank. space in Section 1.13 the words, "Building Division of the Department of Public Works of the City of Lodi." (h) Part 2 is hereby deleted and not adopted. (i) In Section 201, paragraph (k) , first line, delete the words "Section 2.5 ." In line 3 delete the words "Board of Plumbing Examiners, " and add the words "City Council. " In line 5 delete the word "Board" and add the word "Council. " (j) On Table A in that certain grouping of materials headed Nonmetallic Piping, del@e " Bituminized fiber sewer pipe and fittings . " -2- I (k) Add to the last sentence of Section 504, paragraph (a), "but in no case less than 4 inches. " a] Under Section 504 (ak, that paragraph identified "Exception" is hereby deleted and not adopted. Section 4. There is hereby adopted a new Section 18.3 of the Code of the City of Lodi to read in full as follows: Sec. 18.3. Permits. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this chapter. violate or cancel the provisions of this chapter shall be valid, except insofar as the work or use which it authorizes is lawful. No permit presuming to give authority to The issuance of a permit upon plans and specifications shall not prevent the administrative authority from thereafter requiring the correction of errors in such plans and specifications or from preventing construction operations being carried on thereunder when in violation of this chapter or of any other ordinance or from revoking any certificate of approval when issued in error. Every permit issued by the administrative authority under the provisions of this chapter shall expire by limitation and become null and void if the work authorized by such permit is not commenced within sixty days from the date of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of sixty days. Before such work can be recommenced, a new permit shall be first obtained to do so. Section 5. There is hereby adopted a new Section 18.4 of the Code of the City of Lodi to read in full as follows: Sec, 18.4. Violations of chapter. Any person, firm or corporation violating any of the provisions of this code shall be deemed guilty of a misdemeanor. Each separate day or any portion thereof -3- j. during which any violation of this code occurs or continues shall be deemed to constitgte a separate offense, and upon conviction thereof shall be punishable as herein provided. Section 6. This ordinance shall be published one time in the "Lodi News Sentinel,? ,a yewspaper of general circulation printed and published in the City in force and take effect thirty days after its passage.
