HomeMy WebLinkAboutOrdinances - No. 793ORDINANCE NO. 793 AN ORDINANCE AMENDING SECTIONS 27-9, AND 27-11 OF THE CODE OF THE CITY OF LODI AND THEREBY PROVIDING SOLID SCREENING BETWEEN ALL COMMERCIAL AND RESIDENTIAL DISTZICTS 27-10 WHEREAS, the City Council has determined that: in order to properly screen residential property from commercial property for the purpose of tending to prevent the view of the businesses to be con-- ducted thereon; to lessen the amount af dirt, dust, debris, and traffic noises that might be generated on the commercial property, that it should be the obligation of the owner of the coLmoercia1 property to construct a screening area to eliminate these Dbjections for the health, safety and comfort of the residentially-mned property j now therefore The City Council of the City of Lodi does ordain as follows: Section 1. Section 27-9(d)1. of the Code of the City of Lodi is hereby amended to read in full as follows: 1. hts adjacent to a residential zone, upon development for non-residential purposes, shall be screened mith a solid fence of wood, masonry, ox such other matesial as approved by the Director of Public Works, six feet in height fox the length of the boundary line between the two districts, excluding the required front yard or street side yard where the property shall be landscaped or screened by a three and one-half foot solid fence of the same material. All fencing erected undex this section shall be main- tained in good condition, Section 2. Section 27-10 of the Code of the City of Lodi is hereby amended by adding thereto the following subsection (d) : (d) Lots adjacent to a xesidential zone, apon development fox non-residential purposes, shall be screened with a solid fence of wood, masonry, Qr such other material as approved by the Director of Public Works, six feet in height for the length of the boundary line between the two districts, excluding the required front yaxd or stzeet side yard where the property shall be landscaped or screened -1- by a three and one-half foot solid fence of the same material. All fencing erected under this section shall be maintained in good condition. Section 3. Section 27-11 of the Code of the City of Lodi is hereby amended by adding thexe to the following subsection (d) : (d) Lots adjacent to a residential zone, upon development for non-residential purposes, shall be screened With a solid fence of wood, masonry, or such other material as approved by the Director of Public Works, six feet in height for the length of the boundary line between the two districts, excluding the required front yard or street side yard where the property shall be landscaped or screened by a three and one-half foot solid fence of the same material. All fencing erected under this section shall be maintained in good condition. Section 4. This ordinance shall be published one time in the Wadi News Sentinel," a daily newspaper of general circulation printed and published in the City of Lodi, and shall be in force and take effect thirty days from and after its passage and approval.
