AN ORDINANCE AMENDING SECTION 11-3 AND SECTION 11-8 OF THE CODE OF THE CITY OF LODI AND TBEREBY PROVIDING FOR AN INCREASE IN THE FEES FOR GARBAGE
SERVICE TO PRIVATE DWELLINGS AND AN INCREASE IN
THE FEE FOR PERMIT FOR PERSON TO REMOVE OWN GARBAGE
The City Council of the City of Lodi does ordain as follows:
Section 1. Section 11-3 of the Code of the City of Lodi is
hereby amended to read in full as follows:
Sec. 11-3. Collection rates. The monthly rates to be
charged for garbage collection service Lt any private dwelling house
or residence shall be as follows for one garbage collection weekly:
For the first container of thirty gallons or less, one
dollar and thirty cents,
For the second container of thirty gallons or less, fifty
cents.
For larger quantities or more frequent collections, such
amount as may be mutually agreed upon by the customer and the city
garbage collector, or determined by the city council. All owners
of flats, apartments, business houses and places not a private
dwelling or the tenants or lessees thereof shall pay such an amount
monthly as may be determined by them and the city garbage collector,
or, if they cannot agree, by the city council. In the event that
a satisfactory fee cannot, in any case, be otherwise arranged, the
matter shall be submittred in writing by the city clerk to the city
council, which shall fix the collection fee, by resolution, and
its decisiori8+shall be final. None of the rates referred to herein
and agreed upon with the customer, and not ordered by the council,
shall be effective until the garbage collector shall have filed
with the city clerk a statement of the amount to be charged, if
in excess of one dollar and thirty cents per month.
Section 2. Section 11-8 of the Code of the City of Lodi is
hereby amended to read in full as follows:
Sec. 11-8. Permit for persons to remove own garbage.
Every owner of garbage shall have the right to remove the same,
but it shall be unlawful for any person to remove garbage from more
than one place and no person, other than the regular garbage col-
lector of the city, shall move any garbage over any of the streets
of the city without obtaining a permit to do so. Such permits shall
be issued by the city clerk on application and on the payment of
the sum of ten dollars covering one calendar year beginning Janu-
ary first. Permits issued after January first of any year will be
issued for a prorata charge covering the unexpired part of the year.
Section 3. This ordinance shall be published one time after
its passage in the Lodi News-Sentinel, a daily newspaper of general
circulation printed and published in the City of Lodi, and shall be
in force and become effective on all service rendered 30 days from
and after its passage, i.&, January 15, 1965.
