HomeMy WebLinkAboutOrdinances - No. 748ORDINANCE NO. 748 AN ORDINANCE OF THE CITY OF LODI ESTABLISHING A PEDESTRIAN MALL WITHIN THE EAST 160 FEET OF THE ALLEY IN BLOCK 9 AS SHOWN UPON MAP ENTITLED "MOKELUMNE1' (NOW CITY OF LODI) PURSUANT TO THE PROVISIONS OF STREETS AND HIGHWAYS CODE SECTION 11100, ET SEQ . The City Council of the City of Lodi does hereby find: 1) That due and legal notice has been given by publication, posting and mailing, of the time and place set for the public hear- ing for the establishment of a Pedestrian Mall within the East 160 feet of the alley in Block 9, as shown upon the map entitled "Mokelumne" (now City of Lodi), as required by Resolution of Intention No. 2598 of the City of Lodi. 2) That at the time and place of the hearing of said Resolution, to wit, May 15, 1963 at 8:OO p.m. in the Council Chambers at the City Hall in the City of Lodi, no protests or objections to the establishment of the proposed Pedestrian Mall were received, and no written claim of damages haa been filed with the City Clerk of the City of Lodi alleging that any legal damages will accrue to any person by reason of the establishment of said Pedestrian Mall. 3) That all of the conditions and requirements set forth in Section 11100, et. seq. of the Streets and Highways Code have been complied with so that it is now in order for the City Council of the City of Lodi to adopt an ordinance establishing said Pedes- trian Mall. NOW, THEREFOFS3, the City Council of the City of Lodi does ordain as follows: Section 1. A Pedestrian Mall is hereby established within the East 160 feet of the East-West alley as shown in Block 9 on the map entitled ltMokelumnefl (now City of Lodi) which map is on file in the office of the County Recorder of San Joaquin County. 1. Section 2. All vehicular traffic shall be prohibited within said Pedestrian Mall except that deliveries to the establishments facing on said Pedestrian Mall may be permitted by those vehicles and at such times of the day as may be subsequently established by resolution of the City Council of the City of Lodi. Section 3. Any existing easements for public utility lines located within said Pedestrian Mall are hereby reserved to the City of Lodi. Section 4. This ordinance shall be published one time in ,@he "Lodi News Sentinel" and shall be in full force and take e ffect s from and after its passage and approval.
