HomeMy WebLinkAboutOrdinances - No. 746ORDINARCE NO. 746 AN ORDINBMCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "ERICH ADDITION,'t TO THE CITY OF LODI BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LODIt WHEIIEAS, on the 6th day of February, 1963, the Council of the City of Lodi did pass and adopt Resolution No. 2597 giving notice of the proposal to annex certain uninhabited territory to the City of Lodi, said territory being therein designated a8 "Erich Addition," said Resolution describing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution go. 2597 did contain a notice of the day, hour and place when and where the Council of the City would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being not less than forty nor more than sixty days from the date of passage of said Resolution; and WHEREAS, said Resolution wae duly published in accordance with law; and WHEREAS, on the 20th day of Narch, 1963, at the hour of 8 p.m., in the Council Chambers in the City Hall of the City of Lodi, County of San Joaquin, State of California, said time and place being the day, hour and place fixed in said Resolution No. 2597 for hearing protests to the said annexation, the said City Council did hear and pass upon all protests made to the proposed annex- ation and did determine that protests had not been made by the owners of one-half of the value of the privately owned territory proposed to be annexed as shown by the last equalized assessment roll, nor by public owners of one-half of the value of the publicly owned territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the City of Lodi, and is uninhabited territory in the County of San Joaquin; and WHEREAS, the Planning Commission of the City of Lodi has recommended that said territory proposed for annexation be classi- fied in the R-2 One Family Residential Zone except for approxi- mately seven acres in the northeast area of said territory to be classified in the M Industrial Zone; *ROW, THEREFORE, the said Council of the City of Lodi does hereby approve the annexation of the territory hereinafter described to the City of Lodi, and does hereby further ordain that the said territory be and is hereby annexed to the City of Lodi, and that said territory be and is hereby classified in the R-2 One Pamily Residential Zone, except the following described portion of said territory which is hereby classified in the X-Industrial . Zone: -1- Portion of the Northeast Quarter of Section three (3), Township three (3) Borth Range six (6) East, Mount Diablo Base and Meridian, San Joaquin County, California and being described as follows: Commenoing at a point being 743.3 feet North of the aouth line of said Quarter and 968. feet Westerly of the east line of said Quarter, said point being also the aouthwest corner of that certain 19.08 acre parcel as conveyed to General Mills, Inc.$ by deed recorded in Book 1711 of Official Records, at page 189, San Josquin County Records and run North OoO1* West and parallel with said east line of said Quarter, 347;45 feet to the true point of beginning; thenoe North 89 34' West and parallel with said south line of said Quarter, 609.6 feet; thence Rorth 0001' West and parallel with said east line, 739-3 feet to the point of beginning of that certain 28.99 acre parcel as conveyed to General Mills, Inc., by deed recorded in Book 1822 of Official Records, at page 513, Sari Joaquin County Records; thence North 88O38' East, 55.9 feet; thence South 00081 West, 238.2 feet; thence North 8g058' East, 554.3 feet, more or less, to a point being 968. feet westerly of said east line said point being also the northwest corner of the afore- mentioned 19.08 aore parcel; thence South O0Olt East, 507.35 feet to the true point of beginning and containing 7.368 acres. That said territory, the annexation of which to the City of Lodi is herein approved, is a11 that territory situate in the County of San Joaquin, State of California, more particularly descrribed as follows: A portion of the Northeast Quarter of Section 3, Township 3 North, Eange 6 East, Mount Diablo Base and Meridian, San Joaquin County, California and more particularly described as follows: Beginning at a corner of the boundary line of the City of Lodi, which point is on the East line of the Northeast Quarter of Section 3, Township 3 North, Range 6 East, Mount Diablo Base and Meridian and 743.3 feet northerly from the Southeast corner of said Hortheast Quarter; thence Westerly 968 feet along a line parallel to the South line of said Northeast Quarter to a corner of the City boundary line, which point is the true point of beginning; thence continuing Borth 88' 54' West a distance of 552 feet, more or less, to the East line of the property deeded to Everts F. Mills et ux, as recorded January 6, 1954 in Volume 1826, page 27, San Joaquin County Records; thenoe Bortherly 16.7 feet, more or less, along the East boundary of said Mills property to a corner of said property; thence Westerly 1,070 feet, more or less, along the Worth boundary of said Mills property to the East line of Sacramento Road, which line is 40 feet East of the Vest line of the Northeast Quarter of Section 3; thence Mortherly 1,050 feet, more or less, along the East line of Sacramento Roaa to the South line of the 77.07 acre tract deeded to Raymond Leslie Gerard, as recorded April 8, 1909 in Book "A" of Deeds, Volume 158, page 365, San Joaquin County Records, which line is 1,207.5 feet South of the North line of said Northeast Quarter; thence Easterly 1,016.1 feet along a line parallel to the North line of said Northeast Quarter to a corner of the existing City Boundary; thence North 88O 38' East a distance of 55.9 feet along the City Boundary to a corner Of said boundary; thence South Oo 8' West 238.2 feet along the City Limit Line to a boundmy corner; thence North 89O 58' East 557.3 feet along the City Boundary Line to a boundary corner; thence Southerly 854.8 feet along a line parallel to the East line of said Northeast Quarter of Section 3, this line also a City Boundary Line, to the true point of beginning; the area thus described con- taining 36.6 acres, more or less.
