HomeMy WebLinkAboutOrdinances - No. 741ORDINANCE NO. 741 AN ORDINANCE OF THE CITY OF LODI ESTABLISHING THE LODI POLICE AUXILIARY AND REPEALING ORDINANCE NO. 279 The City Council of the City of Lodi does ordain as follows: Section 1. Ordinance No. 279 is hereby repealed. Section 2. A Lodi Police Auxiliary, hereinafter called "AuxiliaryYt1 is hereby established as a voluntary organization composed of persons appointed by the Chief of Police, hereinafter called the "Chief." Membership in such Auxiliary shall not exceed the number of regular officers in the department. Section 3. Subject to the provisions of this chapter, the Chief shall have complete authority and control over the Auxiliary. He may appoint as members thereof any persons whom he deems to be qualified, and he may reject an application for membership. He may provide for the training of candidates for membership, and for the further training of members. Section 4. No person shall become a member of the Auxiliary until he has taken the training and is able to meet all other requirements prescribed by the Chief. When so qualified and selected, he shall then be sworn in by the City Clerk as a member of the Auxiliary. Section 5. The duty of the Auxiliary, subject at all times to the direction, supervision and control of the Chief, shall be to assist the regular members of the police department in the enforcement of law and the maintenance of peace and order whenever and wherever its services are required. The Chief may, by order, establish rules and regulations to govern the Auxiliary , including the fixing of specific duties of its members in the providing for the maintenance of discipline. He may change such orders from time to time. Section 6. The Auxiliary may be assigned to functions at which members of the public may assemble in relatively large numbers where there may be a problem of a breach of the peace -1- I I and control of the crowd is important in the experience and opinion of the Chief. Section 7. A member of the Auxiliary, when on duty as assigned by the Chief, shall have the authority given to officers of the police department to direct traffic and shall have the same power of arrest granted a regular member of the police department, subject to any limitations which the Chief may impose. Section '0. Subject to the provisions of Section 2, the Chief may, by order, diminish or expand the membership of the Auxiliary as an existing or contemplated condition or emergency may require. The membership of any persm in the Auxiliary may be terminated by the Chief at any time, and such member may resign from the Auxiliary at any time upon notifying the Chief in writing of his r es igna t ion. Section 9. The uniform for members of the Auxiliary shall be similar to the uniform worn by members of the regular police department, with an identifying insignia to be prescribed by the Chief. Side arms are to be carried in the regulation police Sam Brown belt and holster. An identification card, badge and cap piece, and such other insignia or evidence of identification as the Chief may prescribe, shall be issued to each member who must carry the card at all times. Each member must surrender all city property issued to him upon the termination of his membership. The uniform, badge and cap piece may be worn, and the gun and baton carried, only while on duty as assigned by the Chief. SectionlO.. No member of the Auxiliary shall carry any fire- arm until he has qualified for, and received permission from the Chief. -% Section U. It shall be unlawful for any person to imper- sonate or falsely represent himself to be a member, or to wear, use, or possess a badge, cap or insignia used by the Auxiliary. -2- Section 12. Each member of the Auxiliary while acting under the direction of the Chief during a regular assigned tour of duty, is an employee of the City and is entitled to receive compensation from the City in accordance with the provisions of Sec. 3362 of the Labor Code of the State of California. Section 13. This ordinance shall be published one time in the Lodi News Sentinel, a daily newspaper of general circulation printed and published in the City of Lodi, and shall be in full force and take effect thirty days from and'after its passage and approval.
