HomeMy WebLinkAboutOrdinances - No. 730ORDINANCE NO. 730 AN ORTXNANCE BPPROKDIG THE ANNEXATION OF CmTAIN u"HiBITm TERRITORY, DESIGNATED VCHEPPLER ADDITION't TO THE CITY OF TXDI BE IT ORDAINED BY THE COUNCIL OF mE CITY OF MDI: WHEREAS, on the 20th day of June, 1962, the Council af the City of Lodi did pass and adopt Resolution No. 254s giving notice of the proposal to annex certain uninhabited territory to the City of Lodi, said territory being therein designated as t%cheppler Additian, tt said Resolution describing the boundaries of the territory proposed to be annexed;.and and place when and where the Council of the City would hear protests made by any person awning real property within the terrihry proposed to be annexed, the time of said hewing being not less than forty nor more than sixty days from the date of passage of said &solution; and WREREAS, said Resolution No. 2545 did contain a notice of the day, hour WHEREAS, said Resdu45on was duly published in accordance with law; and GJHEREAS, on the Gtb day of August, 1962, at the hour of 8:00 pa,, in the Council Chambers in the City Hall of the City of Lodi, County of San Joaquin, State of California, said time and place being $he day, hour and place fixed in said Resolution No. 2545 for hearing protests to the said amexation, the said City Courlcildid hear and pass upon all protests made to the proposed arinexatian and did determine that protests had not been made by the owners of one- of the value of the privately owned territory proposed to be annexed 88 shown by the last equalized assessment roll, nor by public owners of one-half of the value of the puWxly owned territorg proposed to be annexed as determined by said Legislative body; and WHEREAS, said %mitory is contiguous to the City of Lad% and is Wn- habited territory in the County of San Joaquin; and WHEREAS, the Planning Camiss%on of the City of WS. has recammended that the northerly 132.38 feet of the territory proposed for annewtion be classified Pn the R-3 Wted PlULttple Fanily Residential Zone and that the remainder of said territory, excludzng areas within publ3c streets, be classified in the C-P Ccmuercial. Professional. Office Zone; NOW, THEREFORE, the said Council of $he City of Ld does hereby approve the annexation of the territory hereinaf'ter descr5bed to the City of Ladi, and does hereby further ordain that the said Lerritory be and is hereby annexed to the City of Lodf, that the northerly 132.38 feet of said territory be and is hereby classified in the R-3 Wted Multiple Family Residentfa& Zone and that the remainder of said territory, exchding areas within public streets, be and is hereby classified in the C-P ConZmeTcial-Professional Office Zone, Wt said territory, the annexation of which to the City of. Lodi is herein approved, is all that territory situate in the County af San Joaquin, State of California, more particularly descxibed as follows: A portion of the East Half of Sectioi ll, Township 3 Nofih, Raige 6 East, Womt Diablo Base and Meridian, San Joaquin County, California, and more particularly descz3bed as follows: Beginning at a point on the West line of the East Half of Section 11, Township 3 North, Range 6 Easb, Mount Diablo Base and Neridian, which point is 5.8 feet south of the southwest corner of the Northeast Quarter of said Seotion; thence northerly 392.18 feet abng the West line of said East Half of Section U, tfris line being also a boundary line of the City of Lo&, to a corner of the Citx bits; thence easterly 717.33 feet a3ong a line parallel to the South line of said Northeast Quarter, this line dtso a City Limit Line, to the East line of Faimont Avenue; thence South 0' 101 West a distance of 386.38 feet dong the East line of Fairmont Avenue, also a City Unit Line6 to the South line of said Mortheast Quarter; thence South 89 07' East a distance of 2.67 feet along the South line of said Northeast Quarter, also a City &hit Line, to a point; thence South Oo 108 West a distance of 2643.6 feet along the East line of Fdnnont Avenue, also a City Unit Line, to the South line of Section 1L; thence North 89O 073! West along the South line of Section 11 a distance of 60 feet to the ex'bended West line of Fairmont Avenue; thence North Oo 2.0' East a distmce of 2639.2 feet along the West line of Fairmont Avenue, also a City Limit Line, to a corner of the Lodi City Limits, which is 4.4 feet south of the South line of the Northeast Quarter of Section 11; thence North 89' 14' West a distance of 660 feet to the pdnt of beginning; the area thus described containing 10.0 ac~es, more or less, Approved this 5th day of September, 1962.
