HomeMy WebLinkAboutOrdinances - No. 699ORDINANCE NO. 699 AN ORDINANCE APPROVING Tm ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "CHIAPPE ADDITION" TO THE CITY OF LODI BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LODI: WHEREAS, on the 22nd day of June, 1961, the Council of the City of Lodi did pass and adopt of the proposal to annex certain uninhabited territory to the City of Lodi, said territory being therein designated as Whiappe Addi- tion, proposed to be annexed; and Resolution No. 2450 giving notice said Resolution describing the boundaries of the territory WHEREAS, said Resolution No. 2450 did contain a notice of the day, hour and place when and where the Council of hear protests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being not less than forty nor more than sixty days from the date of passage of said Resolution; and the City would WHEREAS, said Resolution was duly published in accordance with law; and WHEREAS, on the 2nd day of August, 1961, at the hour of 8 p.m., in the Council Chambers in the City Hall of the City of Lodi, County of San Joaquin, State of California, said time and place being the day, hour and place fixed in said Resolution No. 2450 for hearing protests to the said annexation, the said City Council did hear and pass upon all protests made to the proposed annexation and did deter- mine that protests had not been made by the owners of one-half of the value of the privately owned territory proposed to be annexed as shown by the last equalized assessment roll, nor by public owners of one-half of the value of the publicly owned territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the City of Lodi, and is uninhabited territory in the County of San Joaquin; NOW, THEREFORE, the said Council of the City of Lodi does hereby approve the annexation of the territory hereinafter described to the City of Lodi, and does hereby further ordain that the said territory be and is hereby annexed to the City of Lodi. That said territory, the annexation of which to the City of Lodi is herein approved, is all that territory situate in the County of San Joaquin, State of California, more particularly described as follows: A portion of the Northwest Quarter of Section 11, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, County of San Joaquin, State of California, and further described as follows: Beginning at the Southeast corner of the Northwest Quarter of-Section 11, Township 3 North, Range 6 East, Mount Diablo Base and Meridian; thence Westerly along the south line of said Quarter 150 feet to the true point of beginning; thence continuing Westerly along the south line of said Quarter 1170.6 feet, more or less, to the southwest corner of the parcel deeded to Anthony Chiappe and Gladys Bernice Chiappe by deed recorded January 19, 1960 in Book 2258, page 161, San Joaquin County -cords; thence northerly 409.63 feet along the west line of said parcel to the northwest corner of said parcel; thence Easterly 957.31 feet along the north line of said parcel to the southwest corner of the parcel deeded to Anthony Herbert Chiappe by a decree of final distribution recorded on October 9, 1959, in Book 2225, page 216, San Joaquin County Records; thence North Oo 69 East along the west line of said parcel deeded to Anthony Herbert Chiappe 409.63 feet to the northwest corner of the property deeded to Bernice Chiappe by deed recorded Anthony Chiappe and Gladys on January 19, 1960 in 2. , Book 2258, page 160, San Joaquin County Records; thence Easterly along the north line of said parcel 213.2 feet, more or less, to the present City Limit Line, which is 150 feet West of and parallel to the east line of said Quarter Section; thence Southerly along the City Limit Line 819.26 feet to the true point of beginning; t thus described containing 13.0 acres, more or * Approved this 16th da Attest: BEATRICE State of California County of San Joaquin ss. hereby certify that the foregoing Ordinance No. 699 was regularly introduced in the City Council of said City on August 2, 1961 and was thereafter passed, adopted and ordered to print by said City Council in regular meeting held August 16, 1961, by the following vote: AYES : Councilmen - BROWN, KATZAKIAN, MITCHELL, ULLMANN and CULBERTSON NOES: Councilmen - None ABSENT: Cquncilmen - None I further certify that Ordinance No. 699 was signed ,bpE the , d&A! ,.C Mayor on the date of its passage,and th?t it has been ---_ I ' -,' pursuant to law. 3.
