HomeMy WebLinkAboutOrdinances - No. 618In the City Council citv of Lodi ~&i, California JUL 2.9 ORDINANCE NO. 618 ORDERING THE VACATION OF MAPLE STRFET WEST OF STOCKTON STREET WHEFEAS, this City Council, acting in accordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of this State (the Street Vacation Act of 19411, did on the 16th day of April, 1958, pass and adopt its Resolution of Intention No. 2115, therein declaring the intention of said City Council to vacate a portion of Maple Street as particularly described in said Resolution, and WHEREAS, notice of said intended vacation was regularly given by publication and by posting, both in time, form and manner as required by law as is evidenced by affidavits on file and of record in the office of the Citx Clerk of the City of Lodi, and WKEREAS, in accordance with the provision stated in said Resolution No. 2115 and also contained in the posted notices of the adoption of said Resolution, notice was given that a public hearing would be held before said City Council in the City Council Chambers, City Hall, Lodi, California, beginning at 8:OO o'clock p.m. of Wednesday, May 21, 1958, where and when any person interested in or objecting to said street vacation could appear and be heard in relation thereto, and WHEREAS, at that time and place a pub$ic hearing was held and conducted and testimony received for and against the vacation contemplated, and from the evidence submitted, the City Council of the City of Lodi did on the 21st day of May, 1958, determine that said portion of street is unnecessary for present or future public use and did so find and declare, now therefore, 1. THE CIm COUNCIL OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS: Section 1. The following described portion of street in the City of Lodi is hereby ordered vacated, closed up and aban- doned : The North Twenty (20) feet of Lot 69 and the South Thirty (30) feet of Lot 70 of Lodi Barnhart Tract, as filed for record November 5, 1906, in Vol. 3, at page 48, Book of Maps and Plats, San Joayuin County Records. Reserving, however, and excepting from the vacation of said street, the permanent easement and right therein to construct, maintain, repair and operate ling for public utilities , both publicly and privately owned, in, over, and across that certain piece of land, insofar as our title extends, situate, lying and being in the City of Lodi, County of San Joaquin, State of California, and more particularly described as follows : The North Sixteen (16) feet of the South Twenty (20) feet of Lot 70 of Lodi Barnhart Tract as filed for record November 5, 1906, in Vol, 3, at page 48, Book of Maps and Plats, San Joaquin County Records. This Ordinance ;hall be published one time in the “Lodi News-Sentinell’, a newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect at the time and in the manner provided by law. The City Clerk shall cause a certified copy of this ordinance to be recorded in the office of the County Recorder of San as required by Section 8324 of the Streets and this State. this 11th day of June, 1958.
