HomeMy WebLinkAboutOrdinances - No. 60ORDINANCE NO. 60 An Ordinance Giving the Board of Health Authority to Make it Unlawful for Dogs To be upon or in Public Streets or ViaYs,or to Run at Large Without Being Muzzled, Ths Board of Trustees of the City of Lodi do ordain as follows: Sec.1-The Board of Health of the City of Lodi are hereby empowered and directed,when in their judgment the public health and safety demand,to require all dogs in the City of Lodi to be -- muzzled. -. '-. Sec a.-lnIhen the Board of Health by resolution shall declare that the public health and safety demand that all dogs in the City of Lodi be muzzlcd,said Board must immediately post or oause to be posted in at least ten public places in the City of Lodi a notice stating the public necessity and requiring all dogs to be mluzzled t, hours wiihibn twenty-f.our fiom the posting of said notice. - I_ After the expiratign of such time ,It shall be unlawful and a misderfleanor for any person being the owner, or having charge,care or control of any dog,to suffer,allow or permit the same to be upon or in any public sireet,way,alley,park, common or square in the said City of Lodi,or to run at large within the corporate limits of said City,unless there is securely fastened on the head of said dog a muzzle or contrivance sufficiently cover- ing and enclosing the mouth of such dog to prevent the same from biting,lace-?ting,or otherwise inflieting injury upon any person or persons wltH %ts mouth or teeth. Sec.3-The Board of Health may by resolution declare that the necessity for the muzzling of dogs has ceased to exist,and shall publish such resolution by posting ihe same in three public place# in the City of Lodi.Thereupon it shall be lawful to permit dogs to be at large without being muzzled. Sec.4- Any dog found on or in any such public street,way, alley, park,common or square,or running at large within the corporate limits of said City,in violation of this ordinance may and shall be impounded by the City Marshal or Pound Ma$ter,and held and disposed of by him in acgordance with Sections 5,6,and 7 of Ordinance No 6 . of said City,and such Marshal or Pound Master shall receive the 1, .--. compensation therein named for his services rendered hereunder. Sec,%Any violation of this Ordinance shall be punishable . . by a fine not to exceed one hundred dollars,or by imprisonment not exceeding one hundred days,or by both such fine and imprisonment.
