ORDINuNCE NO. 599
APPROVING THE ANNEXATION OF THE BENSON ANNEX TO
THE CITY OF LODI AND DKCLARING THAT THE SAME IS
ANNEXED TO AND XADE PART OF THE CITY OF LODI
WHEREAS , the Boundary Commission of San Joaquin County did
on the 8th day of July, 1957, approve the boundary line descrip-
tion of the hereinafter described territory, proposed for annexa-
tion to the City of Lodi, as to definiteness and certainty, and
WHEiZEkS, on the 7th day of August, 1957, the City Council of
the City of Lodi did initiate proceedings and declare its inten-
tion to annex to said City the hereinafter described uninhabited
territory. Thereupon Resolution No, 2044, giving notice of the
proposed annexation and of the time and place for the hearing of
protests against such annexation, was adopted by said City Coun-
cil, such hearing to be held in the City Council Chambers, City
Hall, Lodi, California, beginning at 8:OO o'clock p.m. of Wed-
nesday, September 18, 1957, and
WHEEZEAS, subsequent to the adoption of said Resolution No,
2044, conforming therewith and with the provisions of the "Annexa-
tion of Uninhabited Territory Act of 1939", notice was g!ven
owners of property within the territory proposed for annexation
by publication of said Resolution No. 2044 in newspapers of general
circulation printed and published in the City of Lodi and in San
Joaquin County outside said City as is evidenced by affidavits
thereof on file and of record in the office of the City Clerk of
the City of Lodi, said publications being completed more than
twenty days prior to the date of hearing set in Resolution No.
2044, and
WHEREAS, on the 18th day of September, 1957, at the hour of
8:OO o'clock p.m. of said day, in the City Council Chambers,
City Hall, Lodi, California, pursuant to resolution and notice
aforesaid, the City Council of the City of Lodi did hold and
conduct a public hearing for the hearing of protests or objec-
tions against the annexation of said territory to the City of
Lodi, and said protests being heard, considered and passed upon
by said City Council, and found to have been made by owners of
less than one-half of the assessed value of the territory proposed
to be annexed as shown by the last equalized assessment roll of
San Joaquin County, California, now therefore
THE CITY COUNCIL OF THE CITY OF LODI DOE3 ORDAIN AS FOLLOWS:
Section 1. The annexation of the following described unin-
habited territory in San Joaquin County, contiguous to the City
of Lodi, designated'8enson Annex" is hereby approved and the same
is herePy declared to be annexed to and made part of the City
of Lodi:
k portion of the Southeast Quarter of Section 3, Township
3 North, Range 6 East Mount Diablo Base and Iv;eridian, San
Joaquin County, and more particularly described as follows:
Commencing at a corner of the present boundary line
of the City of Lodi, which point lies on the East line of
said Southeast Quarter 228 feet, more or less, Northerly
from the Southeast corner of said quarter section, and
sunning Northerly along said East line 578 l/3 feet;
thence Westerly and parallel to the South line of said
section 1365.8 feet; thence Southerly and parallel to the
East line of said section 100 feet, more or less, to the
Northeast corner of that parcel designated as the "Southern
Baptist Addition" and annexed to the City of Lodi by Or-
dinance No, 587, adopted April 3 , 1957, and filed with

the Secretary of State of the State of California, May 6,
1957; thence continuing Southerly along the East line
of said annexed parcel 676 l/3 feet, more or less, to the
Southeast corner of said annexed parcel, which point lies
on the North line of West Lodi Avenue (formerly Sargent
Road) ; thence Easterly along said North line, which line
is also a boundary line of said City, 1255.8 feet, more
or less, to the Southwest corner of that certain parcel
designated "Blazer Addition" and annexed to the City of
Lodi by Ordinance No, 590, adopted June 5, 1957; thence
Northerly along the West line of said annexed parcel 198
feet, more or less, to its Northwest corner; thence Easterly
along the North line of said annexed parcel 110 feet, more
or less, to the East line of said Southeast Quarter Section,
and the point of beginning, and containing 23.84 acres,
more or less.
Reference is hereby made to a map or plat on file in the
office of the City Clerk of this City delineating the boundaries
next above described.
Section 2. This ordinance shall be published one time in
the "Lodi News-Sentinel" , a daily newspaper of general circula-
tion printed and published in the City of Lodi and shall be in
force and take effect thirty days from and after its passage.
Section 3. Upon the effective date of this ordinance, the
City Clerk shall immediately prepare under seal a certified copy
of the ordinance, giving the date of its passage, and transmit
it to the Secretary of State, She shall also comply with the
provisions of such statutes as may be applicable hereto to effect
the purposes hereof.

ex officio Clerk of the City Council of said City, do hereby
certify that the foregoing Ordinance No, 599 was introduced in
regular meeting of said City Council held September 18, 1957,
and was thereafter passed, adopted and ordered to print at a
regular meeting of the City Council held October 16, 1357, by the
following vote :
AIXS : Councilmen - Fuller, Katzakian, Elitchell, Robinson,
and Hughes
NOES: Councilmen - None
ABSENT : Councilmen - None
