HomeMy WebLinkAboutOrdinances - No. 581In the City Council City of Lodi Lodi) California ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITOHY LANDS SOUTH OF hOKJ3LUWE RIVER AND EAST OF HIGH- WAY 99" TO THE CITY OF LODI, AND CL&SIFYING SAID PROPERTY IN THE M INDUSTRIAL ZONE DESIMGATED "6&TH ADRITIW , WHLRFiAS, the Boundary Commission of San Joaquin County did on the 1st day of November, 1956, approve the boundary line des- cription of the hereinafter described territory, proposed for annexation to the City of Lodi, as to definiteness and certainty; and WHEREAS, on the 5th day of Deoembar, 1956, a verified petition requesting the annexation of said Gerritory was ac- cepted by the City Council of the City of Lodi, together with contained signatures the certificate of said City Clerk: that the petitioning owners represent more than one-fourth of the property in said territory both by area and by assessed value, that there are less than twelve registered electbrg residing therein and that said territory is contiguous to the City of Zodi; and WHEREAS, said petition contained a request thaL the property proposed to be annexed to the City of Lodi be zoned in the M Industrial District, and the City Council thereupon referred the petition to the Planning Commission who in turn, after hearing, recommended that the territory proposed for annexation be class- ified in the N Industrial Zone; and WHEREAS, the City Council thereafter adopted Resolution No. 1985, giving notice of the proposed annexat5on and of a time and place for the hearing of protests against annexation, such hearing to be held in the City Council Chamber, City Hall, Lodi, I California, beginning at 8:OO o'clock plm. of Wednesday, January 2, 1957; ad 1 I WHEREAS, subsequent to the adoption of said Resolution No. 1985, conforming therewith and with the provisions of the flAnnexation of Uninhabited Territory Act of 1939" notice was given owners of property within the territory proposed for annexation by publication of said Resolution No. 1985 in news- papers of general circulation printed and published in the City of Lodi arid in San Joaquin County outside said City and -1- by mailing of notices to said property owners as is evidenced by affidavits thereof on file and of record in the office of the City Clerk of the City of Lodi, said publications and said mailing being completed more than twenty days prior to the date of hearing set in KesQlution 110. 1985; and intention of the City Council to classify said territory in the M Industrial zone; znd WHEREAS, on the 2nd day of January, 1957, at the hour of 8100 p.m, of said day, in the City Council Chamber, City Hall, Lodi, California, pursuant to resolution and notice aforesaid, the City Council of the City of Lodi did hold and conduct a public hearing for the hearing of protests or objections against the annexation of szid territory to the City of Lodi, and said protests being heard, considered and passed upon by said City Council, and found to have been made by owners of less than one-half of the assessed value of the territory proposed to be annexed as shown by the last equalized assessment roll of San Joaquin County, California, or by public and private owners of less than one-half of the value of the territory proposedto be annexed as determined by said City Council; now therefore FOLLOWS : NHEREAS, said Resolution No. 1985 contained a notice of the THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS Section 1. The annexation of the following described uninhabited territory in San Joaquin County, contiguous to the City of Lodi, designated 1764th Addition, Lands South of bliokelumne River and bast of Highway 99" is hereby approved and the same is hereby declared to be annexed to and made part of the City of Lodi: A portion of the Southwest Quarter of Section 31, Township 4 North, Range 7 East, and the Northwest Quarter of Section 6, Township 3 North, Range 7 Bast, biount Diablo Base and keridian, San Joaquin County, California and iiiore particularly described as follows: Commencing at a point on the South line of the South- west Quarter of said Section 31, 32 feet, more or less, easterly from the Southwest corner of said Quarter section, which point is also a corner of the present boundary line of the City of Lodi; thence southerly along said City boundary line 99 feet, more or less, to a north line of Lot lC0, as said lot is designated an a map entitled "Wap of Lawrence Homestead Addition," filed April 5, 1920 in Volume 10, page 5, Book of Naps and Plats, San Joaquin County Records; thence easterly along said north line 647*1 feet, more or less, to a corner of said Lot 40; thence northerly along the west line of said Lot 40 to its intersection with the South bank of the Mokelumne River; thence westerly, downstream, along the south bank of said river to its intersection with the west line of said Quarter Section; thence southerly along said West line to the Southwest corner of said Quarter section, which point also lies on said City boundary line; thence easterly along the South line of said Quarter section and said City boundary line 32 feet point of beginning, containing 12.5 acres, more or less. This ordinance shall be published one time in the “Lodi News-Sentinelfr $ a daily newspaper of general circula- tion printed ad publi&ed in the City of Lodi and shall be in force and take effect thirty days from and after its passage. City Clerk shall immediately prepare under seal a certified copy of %he ordinance, giving the date of its passage, and transmit it to the Secretary of State. He shall also comply with the provisions of such statues as may be applicable hereto to effect the purposes hereof. Section 4.
