HomeMy WebLinkAboutOrdinances - No. 570In the, City Council City of Lodi Lodi, California i ORDINANCE HO, 570 OBDINAIICE LPPHOVING THE ANREXnTXOl T IN UNINHABITLD TERliITORY DESIGNATED i!IIGUST3N ADDITION" TO TBE cxn OF LOUI, AND CLASSIFYING SAID PROPERTY IN THE PI-1 INDUSTRIAL ZONE F GE rrJHEREAS, the Boundary Commission of San Joaquin County: did on the 23rd day of July, 1956, approve the boundary line des- cription of the hereinafter described territory, proposed for annexation to the City of Lodi, as to definiteness and certainty; and WHEREAS, on the 15th day of August, 1956, a verified petition requesting the annexation of said territory was ac- cepted by the City Council of the City of Lodi, together with contained signatures the certificate of said City Clerk: that the petitioning owners represent more than one-fourth of the property in said territory both by area and by assessed value, that there are less than twelve registered electors residing therein and that said territory is contiguous to the City of Lodi; and M-iLmASj said petition contained a request that the property proposed to be annexed to the City of Lodi be zoned in the M Industrial Ijistrict, and the City Council thereupon referred the petition to the Planning Coi:imission who in turn, after hearing, recommended that the territory proposed for annexation be class- ified in the bi-1 Industrial zone; and WHEREAS, the City Council thereafter adopted Kesolution No. 1959, giving notice of the proposed annexation and of a time and place for the hearing of protests against annexation, such hearing to be held in the City Council Chamber, City Hall, Lodi, California, beginning at 8:OO o* clock p.m. of Wednesday, October 3, 1956; and WHEREAS, subsequent to the adoption of said Resolution No. 1959, conforming therewith and with the provisions of the "Annexation of Uninhabited Territory Act of 1939It, notice was given owners of property within the territory proposed for annexation by publication of said Resolution Ido. 1959 in news- papers of general circulation printed. and published in the City of Lodi and in San Joaquin County outside said City and by mailing of notices of said property owners as is evidenced by affidavits thereof on file and of record in the office of the City Clerk of the City of Lodi, said publications and said mailing being completed more than twenty days prior to the date of hearing set in hesolution NO. 1959; and WHEREAS, said i'lesolution No. 1959 contained a notice of the intention of the City Council to classify said territory in the Pi-1 Industrial zone; and 8:OO p.m. of said day, in -&he City Ccluncil Chamber, City Hall, Lodi , California, pursuant. to resolutioii and notice aforesaid, the City Council of the City of Lodi did hold and conduct a public hearing for the hearing of protests or c)b jections against the annexation of said twritory to the City of Lodi, and said protests being heard, cocsidered and passed uporl by said City .Council and found to have been made by omers of less than one-hall of the assessed value of the territory proposed to be annexed as shown by the last equalized assessment roll of San Joaquin County, California, or by public ad private owners of less thancmdx&f of the value of the territory proposed to be annexed as deternined by said City Council; now therefore THE CITY COUNCIL OF THE CITY OF LODI ROES ORDAIN AS FOLLOWS : Section 1. The annexation of the following described uninhabited territory in San Joaquin County, contiguous to the City of Lodi, designated "Houston Addition" is hereby approved and the salile is hereby declared to be annexed to and made part of the City of Lodir WHEREAS, on the 3rd day of October, 1956, at the hour of A portion of the south half of Southwest Quarter of Section 6, T311, R7E, i~l.D,B.&IVi.! San Joaquin County and being more particularly described as follows: Beginnin 6, 1303.83 feet (79.02 rods), more or less, from the Southeast corner of said Quarter Section, which point is also a corner of the present boundary of the City of Lodi; thence easterly along said Section line 568.26 feet (34.44 rods) to i! point, which point is 44.58 rods from said Southeast corner; thence rlortherly and parallel to the East line of said Quarter Section 1191.22 feet, more or less, to the north line of East Pine Street (formerly Pope Avenue], which line is also the present City boundary line; thence westerly along said north line and boundary line to its intersection with the East line of Lot 13 in Live Oak Colony No. 1, hap filed Larch 17, 1887, San Joaquin Records, which point is also a corner of the Present City boundary line; thence Southwesterly along said City boundary line across said East Pine Street (formerly Pope kveo) to the Mortheast corner of the Gest twenty-five and eighty-eight one hundredths (25.88) acres of the Southwest Quarter of the Southwest Quarter af said Section 6, which corner at a point on the South line of said Section is also a corner of the present City boundary line; thence southerly along said City boundary line and parallel to the East line of said Quarter bection IlOZ.18 feet, more or less, to the South line of said Section 6, and the point of beginning, containing 15 acres, more or less, Section 2. The hereinabove described property be here- by classified in the MIL Industrial zone to become effective coincident with the effective date of this ordinance, Section 3, . This ordinance shall be published one t&me in the wLodi News-Sentinel", a daily newspaper of general circula- tion printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage, Section 4. Upon the effective date of this ordinance, the City Clerk shall imediately prepare under seal a certified copy of the ordinance, giving the date of its passage, and transmit it to the Secretary of State, He shall also comply with, the provisions of such'statues as may be applicable hereto to effect the purposes hereof, Approved this 17th day of October, 1956.
