ORDINAN
ORDERING THE VACATION OF THAT PORTION
OF FLORA STWET LYING WEST OF MAIN
STREET.
The City Council of the City of Lodi does ordain as
follows :
WHEREAS, this City Council , acting in accordance with
the provisions of Part 3 of Division 9 of the Streets and High-
ways Code of this State (The Street Vacation Act of 1941), did
on the 6th day of June, 1956, pass and adopt its Resolution of
Intention No. 1932 therein declaring the intention of said City
Council to vacate Flora Street as particular'ly described in
said Resolution , and
WHEREAS, notice of said intended vacation was regularly
given by publication and by posting, both in time, form and
manner as required by law as is evidenced by affidavits on
file and of record in the office of the City Clerk of the
City of Lodi, and
WHEREAS, in accordance with Che provision stated in said
Resolution No. 1932 and also contained in the posted notices of
the adoption of said Resolution, notice was given that a public
hearing would be held before said City Council in the City
Council Chambers, City Hall , Lodi , California beginning at
8:00 o'clock p.m. of Wednesday, July 18, 1956, where and when
any person interested in or objecting to said street vacation
could appear and be heard in relation thereto, and
WHEREAS, at aat time and place a public hearing was held
and conducted and testimony received for and against the vaca-
tion contemplated, and from the evidence submitted, the City
Cougcil of the City of Lodi, did on the 18th day of July, 1956,

determine that said street is unnecessary for present or
future public use (excepting a thirty-five foot by forty-give
foot easement therein) and did so find and declare, now there-
fore.
THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS:
Section 1. The following described street in the City of
Lodi is hereby ordered vacated, closed up and abandoned:
Lot Number 14 in Block "A" of Subdivision of Lot 72
of' the Lodi Barnhart Tract, according to the "Plat
of Subdivision of Let 72 of the Lodi Barnhart Tract",
filed July 8, 1908, at 3:lO P.M. in the office of the
County Recorder of the County of San Joaquin, State
of California,,
Reserving, however, and excepting from the vacation of
said street, the permanent easement and right therein to
maintain, operate and construct lines of pipe , conduit, cables,
poles, equipment and fixtures for' the operation of water,
sewer, gas, telephone, and electric lines now located in or to
be located in the following described portion of said street:
The North 35 feet of the East 45 feet of Lot 14 in
Block IfAW of said subdivision entitled "Subdivision
of Lot 72 of the Lodi Barnhart Tractlfo
Section 2. This Ordinance shall be published onetime in
the Lodi News-Sentinel, a newspaper of general circulation
printed and published in the City of Lodi and shall be in force
and take effect at the time and in the manner provided by law.
The City Clerk shall cause a certified copy of this ordinance
to be recorded in the office of the County Recorder of San

hereby certify that the foregoing Ordinance No. 562 was intro-
duced in regular meeting of said City Council held July 18,
1956, and was thereafter passed, adopted and ordered to print
at a regular City Council meeting held August 1, 1956, by the
following vote:
AYES: Councilmen - mller, Hughes, Katzakian, Rob-
inson, and Mitchell
NOES: Councilmen - None
ABSENT: Councilmen - None
