ORDINANCE NO. 557
ORDERING THE VACATION OF THE PUBLIC RIGHTL
AND MILLS AVENUE
OF-WAY AT THE INTERSECTION OF TURNER ROAD
The City Council of the City of Lodi does ordain as
follows :
WHEREAS, this City Council, acting in accordance with the
provisions of Part 3 of Division 9 of the Streets and Highways
Code of this State (The Street Vacation Act of 19411, did on
the 17th day of April, 1956, pass and adopt its Resolution of
Intention No. 1920 therein declaring the intention of said
City Council to vacate that portion of public right-of-way
lying within the intersection of Turner Road and Mills Avenue
as particularly described in said Resolution, and
WHEREAS, notice of said intended vacation was regularly
given by publication and by posting, both in time, form and
manner as required by law as is evidenced by affidavits on file
and of record in the office of the City Clerk of the City of
Lodi, and
WHEREAS, in accordance with the provisions stated in said
Resolution No. I920 and also contained in the posted notices
of the adoption of said Resolution, notice was given that a
public hearing would be held before said City Council in the
G,ity Council Chambers, City Hall, Lodi, California, beginning
at 8:OO o‘clock p.m, of Wednesday, May 16, 1956, where and when
any person interested in or objecting to said street vacation
could appear and be heard in relation thereto, and
WHEREAS, at that time and place a public hearing was held
and conducted and testimony received for and against the vaca-
tion contemplated, and from the evidence submitted, the City
Council ofthe City of Lodi, did on the 16th day of May, 1956,
determine that said right-of -way is unnecessary for present

or future public use and did so find and declare, now therefore,
THE CITY COUNCIL OF THE CITY OF LODI IX3ES ORDAIN AS FOLLOWS:
Section 1. The following described street in the City of
Lodi is hereby ordered vacated, closed up and abandoned:
A parcel of land being and lying in Section 3, T3N, R6E,
M.D.B. & M., and more particularly described as follows:
Beginning at a point which bears South 00 0' 20n
West a distance of 245.83 feet from the Northeast cor-
ner of said Section 3, said point being on the West
line of Gerard Tract as filed on August 8, 1916, in
Book of Maps, Vol. 8, Page 62, Official Records, San
Joaquin County, California; thence North 58' 15 08Iv
West a distance of 45.50 feet to the true point of
beginning; thence along a curve to the right having
radius of 2954.82 feet and a long chord of 220.95 feet
which bears North 55O 40' 42'' West, said curve also
being concentric with and 60 feet distant from the
Southerly line of the Southern Pacific Company right
of way; thence South 72O 44' East a distance of 82,36
feet; thence along a curve to the right to the true
point of beginning, said curve having a radius of
160,OO feet and a long chord of 144.25 feet which
bears South 46' 02' 11'' East.
Reference is hereby made to a map or plat on file with the
office of the City Clerk of the City of Lodi for the particulars
as to the vacatiorjo
S'ection 2. This ordinance shall be published onetime in
the "Lodi News-Sentinel a newspaper of general circulation
printed and published in the City of Lodi and shall be in force
and take effect at the time and in the manner provided by lawe
The City Clerk shall cause a certified copy of this ordinance
to be recorded in the office of the County Recorder of San
Joaquin County as required by Section 8324 of the Streets and
Highways Code of this State,

1956, and was thereafter passed, adopted and ordered to prink
at a subsequept meeting of said City Council held on June 6,
1956, by the following vote:
AYES: Councilmen - Fuller, Hughes, Katzakian, Rob-
inson, and Mitchell
NOES: Councilmen - None
ABSENT: Councilmen - None
I FURTHER CERTIFY that said Ordinance No. 557 was approved
