ORDINANCE NO. 555
ORDERING THE VACATION OF PORTION
OF LAKE STREET IN GERARD TRACT
WHEREAS, this City Council, acting in accordance with the
provisions of Part 3 of Division 9 of the Streets and Highways
Code of this State (the Street Vacation Act of 19411, did on
the 7th day of March, 1956, pass and adopt its Resolution of
Intention No. 1914, therein declaring the intention of said
City Council to vacate a portion of Lake Street in the Gerard
Tract, as particularly described in said Resolution, and
WHEREAS, notice of said intended vacation was regularly
given by publication and by posting, both in time, form and
manner as required by law as is evidenced by affidavits on
file and of record in the office of the City Clerk of the
City oP?’Lodi, and
WHEREAS, in accordance with the provision stated in said
Resolution No. 191% and also contained in the posted notices
of the adoption of said Resolution, notice was given that a
public hearing would be held before said City Council in the
City Council Chambers, City Hall, Lodi, California, beginning
at 8:OO o’clock p.m. of Wednesday, April 4, 1956, where and
when any person interested in or objecting to said street
vacation could appear and be heard in relation thereto, and
WHEREAS, at that time and place a public hearing was held
and conducted and testimony received for and against the vacation
contemplated, and from the evidence submitted, the City Council
of the City of Lodi did on the 4th day of April, 1956, determine

that said street is unnecessary for present or future public
use and did so find and declare, now therefore,
THE CIm COUNCIL OF !L'€IE CITY OF LODI 'DOES ORDAIN AS FOLLOWS:
Section 1. The following described pbrtion of street in
the City of Lodi is hereby ordered vacated, closed up and abandoned:
Beginning at a point S Oo 54*l E and 78.75 feet from the
intersection of the southerly line of the Southern Pacific
Company right of way on the East line of the Northwest
Quarter of Section 2, T3N, R6E, M.D.B. & M.; thence N 890
183p W 261.1 feet to the true point of beginning; thence
S 670 18' E 133.35 feet on an extension of the southerly
line of Holly 'Drive, as said street is Etesignated on a
map entitled ltWestwood Homes No. 311, filed May 25, 1953
in Vol. 3, page 151, Book of Maps and Plats, San Joaquin
County Records, to the intersection of the South line of
Lake Street, as said street is designated on a map entitled
"Map of Gerard Tract", filed August 8, 1916 in Vol. 8,
page 62, Book of Maps and Plats, San Joaquin County Records;
thence N 89O 18P W 383.19 feet along the South line of
said Lake Street to a point 24.90 feet East of the East
line of the Culbertson Tract No. 3, map filed October 18,
1948, in Vol. 13, page 28, Book of Maps and Plats, San
Joaquin County Records; thence along a curve to the left
having a radius of 80 feet and a chord bearing of N 56O
41' 45" E, and a length of 89.46p to the intersection
of the North line of said Lake Street and the East line
of Pacific Avenue as said street is designated on said map
of Westwood Homes No. 3; thence S 89O 189p E 185.42 feet,
along the North line of Lake Street to the point of begin-
ning.
Reference is hereby made to a map or plat on file with the office
of the City Clerk of the City of Lodi for the particulars as to
the vacation.

Section 2. This ordinance shall be published one time in
the "Lodi News-Sentinel", a newspaper of general circulation
printed and published in the City of Lodi and shall be in force
and take effect at the time and in the manner provided by law.
The City Clerk shall cause a certified copy of this ordinance
to be recorded in the office of the County Recorder of San
Joaquin County as required by Section 8324 of the Streets and
Highways Code of this State.

I, HENRY A. GLAVES, JR., City Clerk of the City of Lodi,
do hereby certify that the foregoing Ordinance No. 555 was
regularly introduced in the City Council of said City on
April 4, 1956, and was thereafter passed, adopted and ordered
to print at a statutory meeting of said City Council held
on April 17, 1956, by the folzowing vote:
AYES : Councilmen - Fuller, Hughes, Mitchell,
NOES : Councilmen - None
ABSENT: Councilmen - None
I further certify that said Ordinance No. 555 was approved
Richey and Robinson
by the Mayor on the date of its passage and that the same has
been published pursuant to law.
