HomeMy WebLinkAboutOrdinances - No. 541In the City council City of Lodi Lodi , California ORDINBNCE NO. 541 APPROVING THZ A"EX&TION OF TEIE BBRBERB ADDITION TO THE CITY OF LODI AND DECLARING THAT THiE SAME IS ANNEXED TO AND WE PART OF THE CITY 'W Lo931 WHEREXS, the boundary description of the hereinafter described territory was submitted to the Boundary Commission of San Joaquin County and was presumed definite and certain after the lapse of more than 'twenty days without report from that body, and WHEREAS, on the 3rd day of August, 1955, the City Council of the City of Lodi did initiate proceedings and declare its in- tention to annex to said City the hereinafter described uninhabited territory, thereupon Resolution Nos 1875, giving notice of the proposed annexation and of the time and place for the hearing of protests against such annexation, was adopted by said City Council, such hearing to be held in the City Council Chambers, City Hall, Lodi, California, beginning at 8:OO o'clock p.m. of Wednesday, September 7, 1955, and WHEFEAS, subsequent to the adoption of said Resolution No. 1875, conforming therewith and with the provisions of the "hnexation.of Uninhabited Territory Act of 1939", notice was given owners of property within the territory proposed for annexation by publication of said Resolution No, 1875 in newspapers of general circulation printed and published in the City of Lodi and in San Joaquin County outside said City as is evidenced by affidavits thereof on file and of record in the office of the City Clerk of the City of Lodi, said publications being completed more than twenty days prior to the date of hearing set in Resolution No. 1875, and -1- WHEREAS, on the 7th day of September, 1955, at the hour of 8:oo B'clock p.m. of said day, in the City Council Chambers, City Hall, Lodi, California, pursuant to resolution and notice aforesaid, the City Council of the City of Lodi did hold and conduct a public hearing for the hearing of protests or objec- tions against the annexation of said territory to the City of Lodi, and said protests being heard, considered and passed upon by said City Council, and found to have been made by owners of less than oneihalf of the assessed value of the territory proposed to be annexed as shown by the last equalized assess- ment roll of San Joaquin County, California, now therefore THE CIm COUNCIL OF THE CITY OF LODI DOES ORDlilN AS FOLLOWS: Section 1. The annexation of the following described uninhabited territory in San Joaquin County, contiguous to thet City of Lodi, designa.$ed "Barbera Addition" is hereby approved and the same is hereby declared to be annexed to and made part of the City of Lodi: Beginning at the southwest corner of Section 12, T. 3 N., R. 6 E., Mount Diablo Base and Meridian, thence North 0' 58% 15n East along the west line of said Section 12, 25.03 feet more or less to the north line of Kettleman Lane, thence North 88' 05f 30" East along the north line of Kettleman Lane, being the present boundary line of the City of Lodi, 240.03 feet, thence leaving the present boundary of the City of Lodi South 00 42' 45" West, parallel to the west line of Section 13, T. 3 N., R. 6 E., Mount Diablo Base and Meridian, 225.03 feet, thence South 88' 05' 30" West parallel to the north line of said Section 13 a distance of 240.14 feet more or less to the west line of said Section 13, thence North 0' 42' 45" East along said west line 200.00 feet more or less to the point of beginning, containing 1.24 acres, more or less. - 2- Reference is hereby made to a map or plat on file in the office of the City Clerk of this City delineating the boundaries next above described. Section 2. .This ordinance shall be published one time in the "Lodi News-Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage. Section 3. Upon the effective date of this ordinance, the City Clerk shall immediately prepare under seal a certified copy of the ordinance, giving the date of its passage, and transmit it to the Secretary of State.
