ORDINANCE NO. 540
CRDERING THE VACATION OF THAT PORTION OF FALLS AVENUE LYING WITHIN SCHNEIDER TRACT
WHEREAS, this City Council, acting in accordance with the
provisions of Part 3 of Division 9 of the Streets and Highways
Code of this State (The Street Vacation Act of 19411, did on
the 20th day of July, 1955, pass and adopt its Resolution of
Intention No. 1873, therein declaring the intention of said
City Council to vacate that portion of FaS-1s Avenue lying
within Schneider Tract as particularly described in said Reso-
lution, and
WHEREAS, notice of said intended vacation was regularly
given by publication and by posting, both in time, form and
manner as required by law as is evidenced by affidavits on
file and of record in the office of the City Clerk of the City
of Lodi, and
WHEREAS, in accordance with the provision stated in said
Resolution No. 1873 and also contained in the posted notices
of the adoption of said Resolution, notice was given that a
public hearing would be held before said City Council in the
City Council Chambers, City Hall, Lodi, California, beginning
at 8:oo orclock p.m. of Wednesday, September 7, 1955, where
and when any person interested in or objecting to said street
vacation could appear and be heard in relation thereto,,rand
WH'ER'EAS, at that time and place a public hearing was held
and conducted and testimony received for and against the vacation
contemplated, and from the evidence submitted, the City Council
of the City of Lodi, did on the 7th day of September, 1945,
determine that said street is unnecessary for present or future
public use and did so find and declare, now therefore,

THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN BLS FOLLOWS:
Section 1. The following described street in the City
of Lodi is hereby ordered vacated, closed up and abandoned:
FALLS AVENUE nOM THE WEST LINE OF GWT AVENUE
TO THE EAST LINE OF ROPER AVENUE WS DELINEQLTED ON THE
OFFICIAL MAP OF SCHNEIDER TRACT FILED OCTOBER 25, 1949,
IN VOL. 13, AT PAGE 51, BOOK OF MAPS AND PLATS, sm
JOAQTJIN COUNTY RECORDS, EXCEPTING THEREFROM THE 50
BY 40 FOOT AREA LYING WITHIN THE INTERSECTION OF FALLS
AvEm AND CRESCENT AVENUE.
Reference is hereby made to a map or plat on file Pith the office
of the City Clerk of the City of Lodi for the particulars as to
the vacation.
Section 2. This ordinance shall be published one time in
the "Lodi News-Sentinel", a newspaper of general circulation
printed and published in the City of Lodi and shall be in force
and take effect at the time and in the manner provided by law.
The City Clerk shall cause a certified copy of this ordinance
to be recorded in the office of the County Recorder of San Joaquin
County as required by Section 8324 of the Streets and Highways
Code of this State.

tember 7, 1955, and was thereafter passed, adopted and ordered
to print at a subsequent meeting of said City Council held on
November 16, 1955, by the following vote:
AYES : Councilmen - Fuller, Hughes, Mitchell, Richey and Robinson
NOES: Councilmen - None
