HomeMy WebLinkAboutOrdinances - No. 535In the City Council City of Lodi Lodi , California @gggsg&& ORDINANCE NO. 535 APPROVING THE ANNEXATION OF THE TOKAY GARDENS ADDITION TO THE CITY OF LODI AND DECLARING THAT THE SAME IS ANNEXED TO AND MADE PART OF THE CITY OF LODI WHEREAS, the Boundary Commission of San Joaquin County did on the 8th day of February, 1955, approve the boundary line description of the hereinafter described territory, proposed for annexation to the City of Lodi, as to definiteness and certainty, and WHEREAS, on the 1st day of June, 1955, the City Council of the City of Lodi did initiate proceedings and declare its intention to annex to said City the hereinafter described unin- habited territory, thereupon Resolution No. 1869, giving notice of the proposed annexation and of the time and place for the hearing of protests against such annexation, was adopted by said City Council, such hearing to be held in the City Council Chambers, City Hall, Lodi, California, beginning at 8:oo o'clock p.m. of Wednesday, July 6, 1955, and WHEREAS, subsequent to the adoption of said Resolution No. 1869, conforming therewith and with the provislons of 'the tlAnnexation of Uninhabited Territory Act of 1939", notice was given owners of property within the territory proposed for annexation by publication of said Resolution No. 1869 in news- papers of general circulation printed and published in the City of Lodi and in San Joaquin County outside said City as is evidenced by affidavits thereof'on file and of record in the office of the City Clerk of the City of Lodi, said publi- cations being completed more than twenty days prior to the date of hearing set in Resolution No. 1869, and t" -1- WHEREAS, on the 6th day of July, 1955, at the hour of 8:oo o'clock p.m. of said day, in the City Council Chambers, City Hall, Lodi, California, pursuant to resolution and notice aforesaid, the City Council of the City of Lodi did hold and conduct a public hearing for the hearing of protests or objec- tions against the annexation of said territory to the City of Lodi, and said protests being heard, considered and passed upon by said City Council, and found to have been made by owners of less than one-half of the assessed value of the territory proposed to be annexed as shown by the last equalized assess- ment roll of San Joaquin County, California, now therefore THE CITY COUNCIL OF THE CIm OF LODI DOES ORDAIN AS FOLLOWS : Section 1. The annexation of the following described uninhabited territory in San Joaquin County, contiguous to the City of Lodi , designated "Tokay Gardens Addition" is hereby approved and the same is hereby declared to be annexed to and made part of the City of Lodi: A portion of the Northeast Quarter of Section 11, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, and more particularly described as follows8 Commencing at a corner of the present boundary line of the City of Lodi, which point is 456.4 feet, more or less, southerly and 25 feet westerly from the Northeast corner of said Northeast Quarter; thence westerly along said City boundary line 932 feet, more or less, to a corner of said City boundary line; thence southerly along said City boundary line a distance of 992.9 feet, more or less, to a corner of said City boundary; thence westerly along said City boundary -2- line 970 feet, more or less, to the east line of Fairmont Avenue (formerly Walnut Avenue) ; thence southerly along said east line 715.7 feet, more or less, to a corner of said City boundary line; thence easterly along said City boundary line 970 feet, more or less, to a corner of said City boundary line; thence southerly along said City boundary line 480 feet, more or less, to a corner of said City boundary line, which point is on the south line of said Northeast Quarter; thence easterly along said City boundary line and Quarter section line 932 feet, more or less, to a corner of said City boundary line, which point is 25 feet westerly from the Southeast corner of said Northeast Quarter; thence northerly along said City boundary line to the point of beginning, containing 62.8 acres, more or less. Reference is hereby made to a map or plat on file in the office of the City Clerk of this City delineating the boundaries next above described. Section 2. This ordinance shall be published one time in the "Lodi News-Sentinel", a daily newspaper of general circula- tion printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage. Section 3. Upon the effective date of this ordinance, the City Clerk shall immediately prepare under seal a certified copy of the ordinance, giving the date of its passage, and transmit it to the Secretary of State. with the provisions of such statutes as may be applicable hereto He shall also comply to effect the purposes hereof. GLAVES, JR., City Clerk of the City of Lodi and ex officio Clerk of the City Council of said City, do hereby certify that the foregoing Ordinance No. 535 was intro- duced in regular meeting of said Council held July 6, 1955, and was thereafter passed, adopted and ordered to print at a regular meeting of the City council held July 20, 1955, by the following vote: AYES : Councilmen - Fuller, Hughes, Mitchell, Richey and Robinson NOES: Councilmen - None ABSENT: Councilmen - None I FURTHER CERTIFY that Ordinance No. 535 was approved and signed by the Mayor on the date of its passage and has been published pursuant to law.
