The City Council of the City of Lodi does ordain as follows : Section 1. ReDeal. Ordinance No. 66, entitled "Rn Ordinance Providing Regulations for the Municipal Water Works, and Fixing Rates for Water8', Ordinance No. 56, entitled "An Ordinance Amend- ing Section 30 of Ordinance No. 46, Ordinances of the City of Lodi, Entitled *An Ordinance Providing Regulations for the Muni- cipal Water Works and Fixing Rates for Water'", Ordinance No. 207, entitled "An Ordinance Fixing Rates to be Charged for the Supplying of:. Water Through Meters and Repealing that Portion of Ordinance No. 123 Not Repealed by Ordinance No. 115", and all other Ordinances and parts of Ordinances in conflict herewith, are hereby repealed. 1. Section 2. Rates. The schedule of water rates for the City of Lodi shall be as follows per month: (a) Flat Rates: Single Family Residence ....................... $ 2.00 Two-family Occupancy(one ownership), per unit.. 1.65 Multi-family Residence, per unit .............. 1.40 Adjustments in multi-family rates may be authorized by the Finance Director within a limit of twenty-five per cent (25%) of the rates established herein, when in his judgment such variations are necessary to preserve equity. Adjustments in excess of twenty- five per cent (25%) must be authorized by the City Council. (b) Metered Rates: First 50,000 cubic feet at $ .06 per 100 cubic feet Next 200,000 cubic feet at $ .05 per 100 cubic feet All over 250,000 cubic feet at $ .04 per 100 cubic feet The mhimum monthly bill for supply through a 3/411 meter or smaller shall be $2.00; through a 1" meter, $3.00; and for each 1/2" in- crease in size of meter thereafter, $1.00 per month. A separate meter shall be required for each dweling unit, and the charges established herein shall be levied for each such meter. Section 3. Rates for Outside Service. In those cases where water service is authorized by the City Council outside the cor- porate limits, applicable rates shall be one hundred fifty per cent (150%) of the rates established herein for similar service within the City. Section 4. Saecial Rates. In cases not provided for herein, the rate may be fixed by special contract, as agreed upon by the Finance Director and the Superintendent of Utilities on behalf of the City, and the water user involved. If such rates cannot be agreed upon, the City Council shall fix and determine proper rates, and such determination shall be final. 2. , Section 5. Rates - When Due. Water charges shall in all I cases commence to accrue when water is turned on, at rates pro- portioned for the period from that date until the following last day of the billing period as may be established by the City. Section 6. Penalty. Any person violating any of the pro- visions herein contained, in addition to any other penalty provided herein, shall upon conviction thereof be fined not more than Five Hundred Dollars ($5OO.OO) or shall be imprisoned in the County Jail for not more than thirty (30) days, or shall be subject to both such fine and imprisonment. \ Section 7.
