HomeMy WebLinkAboutOrdinances - No. 511In the City Council City of Lodi Lodi, California ORDINANCE NO. 511 APPROVING THE ANNEXATION OF THE SOUTH HUTCHINS STREET ADDITION TO THE OF LODI AND DECLARING THAT THE SAME I6 ANNEXED TO AND MADE PART OF THE CITY OF LODI WHEREAS, the Boundary Commission of San Joaquin County did on the 11th day of February, 1954, approve the boundary line description of the hereinafter described territory, proposed for annexation to the City of Lodi, as to definite- ness and certainty, and WHEREAS, on the 16th day of June, 1954, the City Council of the City of Lodi did initiate proceedings and declare its intention to annex to said City the hereinafter described un- inhabited territory. notice of the proposed annexation and of the time and place for the hearing of protests against such annexation, was adopted by said City Council, such hearing to be held in the City Council Chambers, City Hall, Lodi, California, beginning at 8:OO o'clock p.m. of Wednesday, July 21, 1954, and Thereupon Resolution No. 1818, giving WHERW, subsequent to the adoption of said Resolution No. 1818, conforming therewith and with the provisions of the "Annexation of Uninhabited Territory Act of 1939", notice was given owners of property within the territory proposed for annexation by publication of said Resolution No, 1818 in news- papers of general circulation printed and published in the City of Lodi and in Ban Joaquin County outside said City as is evidenced by affidavits thereof on file and of record in the office of the City Clerk of the City of Lodi, said publi- cations being completed more than twenty days prior to the date of hearing set in Resolution No. 1818, and -1- WHEREAG, on the 21st day of July, 1954, at the hour of 8:oo o’clock p.m. of said day, in the City Council Chambers, City Hall, Lodi, California, pursuant to resolution and notice aforesaid, the City Council of the City of Lodi did hold and conduct a public hearing for the hearing of protests or objec- tions against the annexation of said territory to the City of Lodi, and said protests being heard, considered and passed upon by said City Council, and found to have been made by owners of less than one-half of the assessed value of the territory proposed to be annexed as shown by the last equalized assess- ment roll of San Joaquin County, California, now therefore THE CITY COUNCIL OF THE CITY OF LODI DOGS ORDAIN AS FOLLOWS: - Section 1. The annexation of the following described uninhabited territory in San Joaquin County, contiguous to the City of Lodi, designated “3outh Hutchins Street Addition” is hereby approved and the same is hereby declared to be annexed to and made part of the City of Lodi: A portion of the Northwest Quarter of Section 12 and a portion of the Northeast Quarter of Section 11, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, more particularly described as follows: Commencing at a point on the south line of the Northeast Quarter of said Section 11, 25 feet westerly from the Southeast corner of said Northeast Quarter, which point is also on the present boundary line of the City of Lodi, and running easterly along said boundary line to the corner of said City boundary, which corner 2s 30 feet, more or less, easterly from the west line of the Northwest Quarter of said Section -2- 12; thence northerly along said City boundary line to a point, which point is 454.4 feet south- erly and 30 feet easterly from the Northwest corner of said Northwest Quarter, said point being also a corner of said City boundary line; thence westerly along said City boundary line a distance of 55 feet, more or less, to a point which is 25 feet westerly of the east line of said Section 11; thence south and parallel to said east line to the point of beginning, containing 2.76 acres, more or less. Reference is hereby made to a map or plat on file in the office of the City Clerk of this City delineating the boundaries next above described. Section 2. This ordinance shall be published one time in the "Lodi News-Sentinel", a daily newspaper of general cir- culation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage. Section 3. Upon the effective date of this ordinance, the City Clerk shall immediately prepare under seal a certified copy of the ordinance, giving the date of its passage, and transmit it to the Secretary of State. He shall also comply with the provisions of such statutes as may be applicable hereto to effect the purposes hereof. Approved this 4th day of August, 1954. ATTEST : -3- I, KENRY A. GLAVES, JR., City Clerk of the City of Lodi and ex officio Clerk of the City Council of said City, do hereby certify that the foregoing Ordinance No. 511 was intro- duced in regular meeting of said City Council held July 21, l9%, and was thereafter passed, adopted and ordered to print at a regular meeting of the City Council held August 4, 1954, by the following vote: AYES : NOES: Councilmen - None ABSENT: Councilmen - None I FURTHER CERTIFY that Ordinance No. 511 was approved Councilmen - Hughes, Mitchell, Richey, Robinson and Fuller and signed by the Mayor on the date of its passage and has been published pursuant to law.
