HomeMy WebLinkAboutOrdinances - No. 496In the City Council City of Lodi Lodi, California ORDINANCE NO. 496 WHEREAS, the Boundary Commission of San Joaquin County did on the 26th day of Xebruary, 1953, approve the boundary line des- cription of the hereinafter described territory, proposed for annexation to the City of Lodi, as to definiteness and certainty, and WHEREAS, on the 16th day of July, 1953, a verified petition requesting the annexation of said territory was accepted by the City Council of the City of Lodi, together with the certificate of said City Clerk that petitioners represented more than one- fourth of the property in said territory both by area and by assessed value; that there are less than twelve registered elec- tors residing therein and that said territory is contiguous to the City of Lodi. of the proposed annexation and of a time and place for the hear- Thereupon Resolution No. 1758, giving notice ing of protests against annexation, was adopted by said City Council, such hearing to be held in the City Council Chambers, City Hall, Lodi, California, beginning at 8:OO olclock p.m. of Wednesday, August 19, 1953, and WHEREAS, subsequent to the adopt'ion of said Resolution No. 1758, conforming therewith and with the provisions of the nAnnexa- tion of Uninhabited Territory Act of 1939", notice was given owners of property within the territory proposed for annexation by publication or said Resolution No. 1758 in newspapers of general circulation printed and published in the City of Lodi and in San Joaquin County outside said City and by the mailing of notices to said property owners as is evidenced by affidavits thereof on file and of record in the office of the City Clerk of the City of Lodi, said publications and said mailing being completed more than twenty days prior to the date of hearing set in Resolution No. 1758, and WHEREAS, on the 19th day of August, 1953, at the hour of 8:OO o'clock p.m. of said day, in the City Council Chambers, City Hz11, Lodi, California, pursuant to resolution and notice afore- said, the City Council of the City of Lodi did hold and conduct a public hearing for the hearing of protests or objections against the annexation of said territory to the City of Lodi, and said protests being heard, considered and passed upon by said City Council, and found to have been made by owners of less than one- half of the property both in area and in assessed value as shown by the last equalized assessment roll of San Joaquin County, California, now therefore THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS: Section 1. The annexation of the following described unin- habited territory in San Joaquin County, contiguous to the City of Lodi, designated "Fifty First Addition, Lands North of West Lockeford Street and West of Ham Lane" is hereby approved and the same is hereby declared to be annexed to and made part of the City of Lodi: A portion of the Northwest Quarter of Section 2, Town- ship 3 North, Range 6 East, Mount Diablo Base and '"leri- dian, San Joaquin County and being more particularly described as follows: Beginning at the point of intersection between the east line of the Northwest Quarter of Section 2, .T3N, R6E, M.D.B.W. and the south line of Lake Street and running westerly along said south line of Lake Street to its intersection with the present boundary line of the City of Lodi, said line being also the east line of Lot 15 as designated on the official map of "Gerard Tract", map filed August 8, 1916 in Book of Maps and - Plats, Vol. 8, Page 62, Records of San Joaquin County; thence southerly along said east line and its southerly extension, said line being also the present boundary line of said City, to the southeast corner of Lot 30 of said Gerard Tract, said corner being also a corner of the present boundary line of said City; thence west- erly along the south line of said Lot 30, said line be- ing line being also the present boundary line of said City, 110.7 feet, more or less, to the northeast corner of the ttRalmar Addition", annexed to the City of Lodi on May 26, 1950, which point is also a corner of the present boundary line of said City; thence southerly along the present City boundary line, said line being parallel to and 110.7 feet westerly from the east line of Lot 31 of said Gerard Tract and the southerly ex- tension thereof, to its intersection with the center line of West Lockeford Street; thence easterly along said center line to its intersection with the east line of the Northwest Quarter of said Section 2; thence northerly along said east line to its intersection with the south line of Lake Street and the point of beginning, containing 15.75 acres, more or less. Reference 'is hereby made to a map or plat on file in the office of the City Clerk of this City delineating the boundaries next above described. Section 2. This ordinance shall be published one time in the "Lodi News-Sentinel" , a daily newspaper of general circula- tion printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage. Section 3. Upon the effective date of this ordinance, the City Clerk shall immediately prepare under seal a certified copy "she ordinance, giving the date of its passage, and transmit it to the Secretary of State. He shall also comply with the provisions of such statutes as may be applicable hereto to effect the purposes hereof. Approved this 2nd day of September, 1953. Atte I, HENRY A.
