HomeMy WebLinkAboutOrdinances - No. 483In the City Council City of Lodi Lodi, California ORDINANCE NO. 483 APPROVING THE AIVNEXATION OF THE FIFTIETH ADDITION, ---- LANDS EAST OF LODI hENOHIAL HOSPITAL, TO THE CITY OF LODI AND DECLARING THAT THE SAME IS ANNEXED TO AND KADE PART OF THE CITY OF LODI WHEREAS, the Boundary Commission of San Joaquin County did on the 26th day of February, 1953, approve the boundary line des- cription of the hereinafter described territory, proposed for annexation to the City of Lodi, as to definiteness and certainty, and WHEREAS, on the 4th day of March, 1953, a verified petition requesting the annexation of said territory was accepted by the City Council of the City of Lodi, together with the certificate of said City Clerk that petitioners represented more than one- fourth of the property in said territory both by area and by assessed value; that there are less than twelve registered elec- tors residing therein and that said territory is contiguous to the City of Lodi. Thereupon Resolution No. 1723, giving notice of the proposed annexation and of a time and place for the hear- ing of protests against annexation, was adopted by said City Council, such hearing to be held in the City Council Chambers, City Hall, Lodi, California, beginning at 8:OO o’clock p.m. of Wednesday, April 1, 1953, and WHEmAS, subsequent to the adoption of said Resolution No. 1723, conforming thefewith and with the provisions of the ”Annexa- tion of Uninhabited Territory Act of 1939”, notice was given owners of property within the territory proposed for annexation by publication of said Resolution No. 1723 in newspapers of general circulation printed and published in the City of Lodi and in San Joaquin County outside said City and by the mailing of notices to said property owners as is evidenced by affidavits thereof on file and of record in the office of the City Clerk of the City of Lodi, said publications and said mailing being com- pleted more than twenty days prior to the date of hearing set in Resolution No. J-723, and WHEREAS, on the 1st day of April, 1953, at the hour of 8:OO p.m. of said day, in the City Council Chambers, City Hall, Lodi, California, pursuant to resolution and notice aforesaid, the City Couacil of the City of Lodi did hold and conduct a public hearing for the hearing of protests or objections against the annexation of said territory to the City of Lodi, and said protests being heard, considered and passed upon by said City Council, and,found to have been made by owners of less than one-half of the assessed value of the territory proposed to be annexed as shown by the last equalized assessment roll of San Joaquin County, California, now therefore, THE CITY COUNCIL OF THE CITY OF LODI 1X)ES ORDAIN AS FOLLOWS: Section 1. The annexation of the following described unin- habited territory in San Joaquin County, contiguous to the City of Lodi, designated "Fiftieth Addition, Lands East of Lodi Memorial Hospital',' is hereby approved and the same is hereby de- clared to be annexed to and made a part of the City of Lodi: Portion of the North Half of the Southeast Quarter of Section 11, T3N, R6E, h.D.B.&M., San Joaquin County and being more particularly described as follows: Beginning at a point on the north line of said Quarter, said point being 841.5 feet Westerly of the northeast corner of said Quarter; thence S O0 115' W, 281.5 feet; thence S 89' 07' W, 302.5 feet; thence S Oo llgt W arid parallel to the east line of said Quarter, 889 feet to a point, being 17.735 chains southerly of the north line of said Quarter; thence southerly 25 feet; thence westerly and parallel to said north line, 780 feet, more or less, to the east line -_ of the County road known as Fairrnont kve. (formerly Wainut kve. ) ; thence Northerly along said east road line, being 720 feet easterly of the west line of said Quarter, 1195.5 feet to said north line; thence easterly along said north line , 1083.5 feet to the point of beginning, containing 23.4 acres, more or less. Reference is hereby made to a map or plat on file in the "r office of the City Clerk of this City delineating the boundaries next above described, Section 2. This ordinance shall be published one time in the "Lodi News-Sentinel" , a daily newspaper of general circula- tion printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage. Section 3- Upon the effective date of this ordinance, the * City Clerk shall immediately prepare under seal a certified copy of the ordinance, giving the date of its passage, and transmit it to the Secretary of State. He shall also comply with pro- visions of such statutes as may be applicable hereto to effect the purposes hereof. Approved this 15th day of April, 1953. Attest4 Q Clerk I, HENRY A.
