HomeMy WebLinkAboutOrdinances - No. 482In the City Council City of Lodi Lodi , California ORDINAIYCE NO. &&?2 APPROVING THE ANNEXATIGN OF THE GRATTONE AUDITION TO THE CITY OF LODI AND DECLARING THAT THE SAME IS ANNEXED TO AND MADE PART OF THE CITY OF LODI WHEREAS, the Boundary Commission of San Joaquin County did on the 26th day of February, 1953, approve the boundary line des- cription of the hereinafter described territory, proposed for annexation to the City of Lodi, as to definiteness and certainty, and WHEREAS, on the 4th day of March, 1953, a verified petition requesting the annexation of said territory was accepted by the City Council of the City of Lodi, together with the certificate of said City Clerk that petitioners represented more than one- fourth of the property in said territory both by area and by assessed value; that there are less than twelve registered electors residing therein and that said territory is contiguous to the City of Lodi. Thereupon Resolution No. 1722, giving notice of the pro- posed annexation and of a time and place for the hearing of pro- 1 tests against annexation, was adopted by said City Council, such hearing to be held in the City Council Chambers, City Hall, Lodi, California, beginning at 8:OO o'clock p.m. of Wednesday, April 1, 1953, and WHEREAS, subsequent to the adoption of said Resolution No. 1722, conforming therewith and with the provisions of the "Annexa- tion of Uninhabited Territory Act of 1939", notice was given owners of property within the territory proposed for annexation by publication of said Resolution No. 1722 in newspapers of general circulation printed and published in the City of Lodi. and in San Joaquin County outside said City and by the mailing of notices to said property owners as is evidenced by affidavits thereof on file and of record in the office of the City Clerk of the City of Lodi, said publications and said mailing being com- pleted more than twenty days prior to the date of hearing set in Resolution No. 1722, and WHEREAS , on the 1st day of April , 1953, at the hour of 8:OO p.m. of ssid day, in the City Council Chambers, City Hzll, Lodi, California, pursuant to resolution and notice aforesaid, the City Council of the City of Lodi did hold and conduct a public hearing for the hearing of protests or objections against the annexation of said territory to the City of Lodi, and said protests being heard, considered and passed upon by said City Council, and found to have been made by owners of less than one-half of the assessed value of the territory proposed to be annexed as shown by the last equalized assessment roll of San Joaquin County, California, now therefore, THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS: Section 1. The annexation of the following described unin- habited territory in San Joaquin County, contiguous to the City of Lodi, designated "Grattone Additionff is hereby approved and the same is hereby declared to be annexed to and made part of the City of Lodi: A portion of the Northwest Quarter of Section 2, Town- ship 3 North, Range 6 East, Mount Diablo Base and 1"leri- dian, San Joaquin County and being more particularly described as follows: Lots 29, 32, and 37 as said lots are designated on the map entitled "Gerard Tract" , which map was filed August 8, 1916, in Book of Maps and Plats, Vol. 8, page 62, San Joaquin County Records , excepting the south 30 feet of Lot 37. Containing 5.7 acres, more or less. Reference is hereby made to a map or plat on file in the office of the City Clerk of this City delineating the boundaries next above described. Section 2. This ordinance shall be published one time in the "Lodi News-Sentinel" , a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thrity days from and after its passage. Section 3. Upon the effective date of this ordinance, the City Clerk shall immediately prepare under seal a certified copy of the ordinance, giving the date of its passage, and transmit it to the Secretary of State.
