HomeMy WebLinkAboutOrdinances - No. 473In the City Council City of Lodi Lodi, California ORDINANCE N0.473 APPROVING THE ANNEXATION OF THE -RIECK ADDITION TO THE CITY OF LODI ANDF CLARING THAT THE SAME IS ANNEXED TO AND MADE PART OF THE CITY OF LODI .. WHEREAS, the Boundary Commission of San Joaquin County did on the 7th day of November, 1952, approve the boundary line description of the hereinafter described territory, proposed for annexation to the City of Lodi, as to definiteness and certainty, and WHEREAS, on the 19th day of November, 1952, the City Council of ,the City of Lodi did initiate proceedings and declare its intention to annex to said City the hereinafter described uninhabited territory. Thereupon Resolution No. 1712, giving notice of the proposed annexation and of the time and place for the hearing of protests against such annexation, was adopted by said City Council, such hearing to be held in the City Coun- cil Chambers, City Hall, Lodi, California, beginning at 7:30 o'clock p.m. of Monday, December 22, 1952, and WHEREAS, subsequent to the adoption of said Resolution No. 1712, conforming therewith and with the provisions of the WAnnexation of Uninhabited Territory Act of 1939") notice was given owners of property within the territory proposed for an- nexation by publication of said Resolution No. 1712 in newspapers of general circulation printed and published in the City of Lodi and in San Joaquin County outside said City and by the mailing of notices to said property owners as is evidenced by affidavits thereof on file and of record in the office of the City Clerk of the City of Lodi, said publications and said mailing being completed more than twenty days prior to the date of hearing set in Resolution No. 1712, and 1. WHEREAS, on the 22nd day of December, 1952, at the hour of 7:30 o'clock p.m. of said day, in the City Council Chambers, City Hall, Lodi, California, pursuant to resolution and notice aforesaid, the City Council of the City of Lodi did hold and conduct a public hearing for the hearing of protests or objections against the annexation of said territory to the City of Lodi, and said protests being heard, considered and passed upon by said City Council, and found to have been made by owners of less than one-half of the assessed value of the territory proposed to be annexed as shown by the last equalized assessment roll of San Joaquin County, California, now therefore THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS : Section 1. The annexation of the following described uninhabited territory in San Joaquin County, contiguous to the City of Lodi, designated nRieck Addition'? is hereby approved and the same is hereby declared to be annexed to and made part of the City of Lodi: I A portion of the North Half of the Southeast Quarter of Section 11, T3N, R6E, M. D. B. & M., San Joaquin County and being more particularly described as follows: Beginning at the northwest corner of Homesite Tract as per map thereof filed for record July 23, 1951, in Vol. 13, at page 104, Book of Maps and Plats, San Joaquin County Records and run Easterly, 307.3 feet to the south- west corner of Rieck Tract as per map thereof filed for record February 25, 1952, in Vol. 13, at page 112, Book of Maps and Plats, San Joaquin County Records; thence Northerly along the west line of said Rieck Tract, 290,O feet; thence Easterly along the north line of said Rieck Tract 841.5 feet to the east line of said Quarter; thence O0 llh' E along said east line 1031.85 feet to the northeast corner of said Qua,rter; thence 2. Westerly along the north line of said Quarter, 841.5 feet; thence S 0' lit' W, 281.5 feet; thence S 89O 07' W, 302.5 feet; thence S 0' 11s' W and parallel to said east line of said Quarter $89.9 feet to a point, being 17.735 chains Southerly of the north line of said Quarter; thence Southerly along the northerly extension of the west line of said Homesite Tract, 151.2 feet to the point of beginning, containing 26.9 acres, more or less. Reference is hereby made to a map or plat on file in the office of the City Clerk of this City delineating the boundaries next above described. Section 2. This ordinance shall be published one time in the "Lodi News-Sentinel" , a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage. Section 3. Upon the effective date of this ordinance, the City Clerk shall immediately prepare under seal a certified copy of the ordinance, giving the date of its passage, and transmit it to the Secretary of State. He shall also comply with the provisions of such statutes as may be applicable hereto to effect the purposes hereof. Approved this 21st day of January, 1953. ATTES I, HENRY A. GLAVES, JR., City Clerk of the City of Lodi and ex-officio Clerk of the City Council of said City, do hereby certify that the foregoing Ordinance No. 473 was introduced in regular meeting of said City Council held January 7, 1953, and was thereafter passed, adopted and ordered to print at a regular meeting of the City Council held January 21, 1953, by the following vote : AYES : Councilmen, Preszler, Richey, Rinn and Robinson NOES : Councilmen, None ABSENT: Councilmen, Haskell I FURTHER CERTIFY that Ordinance No. 473 was approved and signed by the Mayor pro tern on the date of its passage and has been published pursuant to lawo 4.
