ORDINANCE NO. 4.66
DECLARING TKE INTENTION OF THE CITY COU&X.L OF THE CITY OF LODf TO VACATE THAT PORTION OF FALLS AVENUE LYING BETWEEN GRANT AVENUE
AND RQPEB AVENUE
WHEREAS, the owners of real property abutting on the

street hereinafter described, have petitioned this City Council
that the same be vacated and closed up as a public street; and

WHEREAS, the City Planning Capmission of' the City of

Lodi has approved the vacation of said street and has so re-
ported to this City Council; and
WHEREAS, this City Uouncil finds and determines that
I w said street is unnecessary for present or prospective street
purposes, therefore,

THE CITY COUHCIL OF THE CITY OP LODI DOES ORDAIN AS
FOLLOWS :
Section 1. It is the intention of the City Council
of the City of Lodi, acting in accordance with the provisions
of Part 3 of D%vision 9 of the Streets and Plghways Code of
' the State of California,

delineated on the Official Map of Scheider Tract
filed October 25, 1949, in Vol. 13, at page 51,
Book of Maps and Plats, Records,
therefrom
within the intersection of Falls Avenue and Cres-
cent Avenue,

Reference is hereby made to a map or PlaN on file with
the offioe of the City Clerk of the City of Lodi for the par-
ticulars as to the proposed vacation.

Section 2. The City Council of the City of Lodi does
hereby find that public convenience and necessity require the
reservationlfexception from said vacations the permanent
easement and right at any time to maintain, operate and con-

struct lines of pipe, conduit, cables, poles, equipment and
fixtures for the operation of water, sewer, gas,
and electric lines now located in or to be locatedA- 5

1, A ten foot area, the center line of which lies
124 feet westerly of the west line of Grant Avenue and lies

125 feet westerly of the west line of Creaaent Avenue and lies
of Falls
Avenue from the east line of Grant Avenue extending westerly
to the west line of Crescent Avenue.

Section 3. NOTICE IS HEREBY GIVEN that this City Corn-
cil does hereby fix WEDXIESDAY, MOVENBER 5, 1952, at the hour
of 8:OO o'clock p.m. and the CITY COUNCIL CHAMBERS, CITY HALL,
LODI, CALIFORMLA, as the time and place when and where all
persons interested in or objecting to the vacation herein
proposed may appear before this City Council and be heard,
Section 4. Upon adoption of thh ordinance the Super-
intendent of Streets shall post, or cause to be posted, notice
of such passage and of the time and place set; herein for
public hearing, in accordance with and in time, form and
manner a8 prescribed by law for the vacation of public streets.

Section 5. This ordinance shall be published one time
in the "Lodi News-Sentinel", a newspaper of general circulation
printed and published in the City of Lodi and shall be in force
and take effect at the time and in the manner provided by law.
