HomeMy WebLinkAboutOrdinances - No. 463In the City Council City of Lodi Lodi, California ORDINANCE NO. 463 APPROVING THE ANNEXATION OF RD ADDITION LANDS BORDERING WEST LODI A& mfi DECLARING THAT THE SAME IS ANNEXED TO AND F-AITZlomT,TFTRF-FITYOFLDm AND- MADE PART OF THE CITY OF LODI WHEREAS, the Boundary Commission of San Joaquin County did on the 25th day of March 1952 approve the boundary line description of the hereinafter described territory, proposed for annexation to the City of Lodi, as to definiteness and certainty, and WHEREAS, subsequent to the approval of said Boundary Commission and on the 15th day of May 1952 a verified petition requesting the annexation of said territory was filed with the City Clerk of the City of Lodi, which petition was presented to the City Council of the City of Lodi on June 18, 1952, to- gether with the certificate of said City Clerk that petitioners represented more than one-fourth of the property in said ter- ritory both by area and by assessed value; that there are less than twelve registered electors residing therein and that said territory is contiguous to the City of Lodi. Thereupon Reso- lution No. 1681, giving notice of the proposed annexation and of a time and place for the hearing of protests against annexa- tion, was adopted by said City Council, such hearing to be held in the City Council Chambers, City Hall, Lodi, California, beginning at 8:00 o‘clock p.m. of Wednesday, July 16, 1952, and WHEREAS, subsequent to the adoption of said Resolution No. 1681, conforming therewith and with the provisions of the “Annexation of Uninhabited Territory Act of 1939”, notice was given owners of property within the territory proposed for annexation by publication of said Resolution No. 1681 in news- papers of general circulation printed and published in the Ord. 3 - 2 City of Lodi and in San Joaquin County outside said City and by the mailing of notices to said property owners as is evidenced by affidavits thereof on file and of record in the office of the City Clerk of the City of Lodi, said publications and said mail- ing being completed more than twenty days prior to the date of hearing set in Resolution No. 1681, and WHEREAS, on the 16th day of July 1952 at the hour of 8:OO o'clock p.m. of said day, in the City Council Chambers, City Hall , Lodi , California, pursuant to resolution and notice afore- said, the City Council of the City of Lodi did hold and conduct a public hearing for the hearing of protests or objections against the annexation of said territory to the City of Lodi, and said protests being heard, considered and passed upon by said City Council, and found to have been made by owners of less than one-half of the assessed value of the territory pro- posed to be annexed as shown by the last equalized assessment roll of San Joaquin County, California, now therefore THE CITY COUMCII, OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS : Section 1. The annexation of the following described un- inhabited territory in San Joaquin County, contiguous to the City of Lodi , designated "43RD ADDITION, LANDS BORDERING WEST LODI AVENUE AND SOUTH FAIRMONT AVENUE" is hereby approved and the same.is hereby declared to be annexed to and made part of the City of Lodi: A portion of the Northeast One Quarter of Section 11, Township 3 North, Range 6 bst, M. D. R. & M. Beginning at a point on the South Line of West Lodi Avenue (Sargent Road) , Nine Hundred Fifty-seven (957 ship 3 North, Range 6 East, and on the present boundary feet West of the East line of Section 11, Town- Or 463 - 3 line of the City of Lodi and running thence West on and along said South Line and said City Boundary Line Six Hundred Eighteen (618) feet to a point thereon that is Five (5) feet North of the Northeast corner of Lot One (1) of "Turnage Subdivision", map filed September 14, 1946, in Vol. 11, page 119, Book of Maps and Plats, San Joaquin County Records; thence S 0' 352' East along the East Line of Turnage Subdivision Three Hundred Seventy-four and Eight-tenths (374.8) feet to the South Line of said subdivision; thence West along said South Line Three Hundred Forty-three and Nine-tenths (343.9) feet to the East line of South Fairmont Avenue (formerly Walnut Avenue); thence S 0' 42' East on and along the East Line of South Fairmont Avenue Nine Hundred Twenty- four and Four Hundred Ninety-five Thousandths (924.495) feet to a point that is Thirty (30) feet East of a point Seventy-one and Thirty-two Hundredths ( 71.32) rods North and Forty-One and Eighty Hundredths (41.80) rods East of the center of Section 11, T)N, R6E; thence East Nine Hundred Sixty-nine and Twenty-four Hundredths (969.24) feet along the South line of the 2.66 acre tract of Cecil B. Clancy to the Southeast corner of said tract; thence North One Thousand Four Hundred Forty-nine and Two Hundred Ninety-five Thousandths (1,449.295) feet along the lands of said Clancy and S. W. Allison to the South Line of West Lodi Avenue (Sargent Road) and the point of beginning, containing 28.11 acres, more or less, exclusive of streets and roads. Ord. 463 - 4 Section 2, This ordinance shall be published one time in the "Lodi News-Sentinellr, a daily newspaper of general circula- tion printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage. Section 3. Upon the effective date of this ordinance, the City Clsrlc shall immediately prepare under seal a certified copy of the ordinance, giving the date of its passage, and transmit it to the Secretary of State. He shall also comply with the provisions of such statutes as may be applicable hereto to effect the purposes hereof.
