HomeMy WebLinkAboutOrdinances - No. 458In the City Council, City of Lodi, Lodi, California ORDINAXCE NO. 458 ORDERIIJG THE VACATION OF THE ALLEY IN BLOCK SIX LATfllLiuCE HL~ESTEAD r,TIDITION WHEREAS, this City Council, acting in accordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of this State (Street Vacation Act of 19411, as amended, did, on the 21st day of May, 1952 pass and adopt its Resolution No. 1679, therein declaring the intention of said City Council to vacate and abandon the alley therein described and as hereinafter sdt forth, and WHEREAS, notice of said intended vacation was regularily given by publication in the manner and form as required by law as is evidenced by affidavits on file in the office of the City Clerk of Lodi, and WHEREAS, in accordance with the provision stated in , said Resolution No. 1679 and also contained in the pub- lished notice of the adoption of said Resolution, notice was given that a public hearing would be held before the City Council in the City Council Chambers, City Hall, Lodi, California beginning at 8:15 o'clock p.m. on Wednesday, June 18, 1952 where and when any person intereste'd in or objecting to said alley vacation could appear and be heard in relation thereto, and WHEREAS, at that time and place a public hearing was held and conducted at which no persons appeared to object to the vacation of said alley and the City Council did then and there determine that said street was unnecessary for present or prospective public use and did so find and declare, therefore, THE CITY CcjUNCIL OF THE CITY OF LODI DOES OKEAIN AS FOLLOWS Section 1. The following described public alley in the City of Lodi is hereby ordered vacated, closed up and abandoned 0 I $.- P,- @!$$:. i:: .k as a public alley: THAT CERTAIN ALLEY RUIWCNG KORTH AND SOUTH IN BLOCK 6, LAWRENCE HOMESTEAD ADDITION AS SHOWN IN NAP NO. 2 OF SAID ADDITION. Reserving, however, and excepting from the vacation of said alley in Block 6, the permanent easement and right therein to maintain, operate and construct lines of pipe, conduit, cables, poles, equipment and fixtures for the operation of water, sewer, gas, telephone and electric lines now located in or to be located in said alley, all as set forth in Section 8330 of the Streets and Highways Code. Section 2. This ordinance whall be published one time in the Lodi Times, a newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect at the time and in the manner provided by law. The City Clerk shall cause a cedtified copy of this ordinance to be recorded in the office of the County Recorder of San Joaquin County as required by Section 8324 of the Streets and Highways Code of this State.
