HomeMy WebLinkAboutAgenda Report - June 4, 1997 (56)AGENDA TITLE: Temporary Restriction of Vehicles for Sale on Elm Street between Lower Sacramento Road and Evergreen Drive MEETING DATE: June 4, 1997 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt the attached resolution approving the restriction of vehicles parked for sale on Elm Street between Lower Sacramento Road and Evergreen Drive (Exhibit A). This restriction is temporary and will be removed as the area is developed by the authority of the Public Works Director as authorized per Lodi Municipal Code Section 10.16.010. BACKGROUND INFORMATION: The following study has been prepared based on requests from owners of the undeveloped lots for sale along Elm Street between Lower Sacramento Road and Evergreen Drive. The request is based on the negative effect the vehicles for sale may have on their ability to sell the lots as well as safety issues related to driver and pedestrian activity created by these parked vehicles. The parking of vehicles for sale on public streets within the City limits is currently regulated under Section 10.44.040 of the Lodi Municipal Code. Subsection C of this Code section indicates that it is unlawful to park any vehicles, vessels, or trailers for sale on any public street within 200 feet of any intersection controlled by a traffic signal or four-way stop. This action was taken based on Council's declaration that displaying these vehicles constitutes a traffic hazard by distracting the attention of passing motorists and pedestrians away from other traffic moving through the intersection. Although this ordinance can be used to enforce parking within 200 feet of Lower Sacramento Road, due to the undeveloped condition along the majority of this segment of Elm Street, vehicles displayed for sale beyond 200 feet from the intersection are still easily visible by drivers on Lower Sacramento Road. Unless regulated, it is likely that vehicles for sale will continue to be displayed in this area until the lots are developed. DISCUSSIONIRECOM MENDATION: Staff is also concerned about the distractions vehicles parked along the roadway can create. Additional concerns are unsafe turning movements, such as U-turns, stopping in traffic lanes, double parking, and unnecessary pedestrian activity. All of these actions can be directly associated with parked vehicles for sale. Based on these factors, staff recommends that signs be posted to prohibit the parking of vehicles for sale along the entire length of both sides of Elm Street between Lower Sacramento Road and Evergreen Drive. It is also recommended that this restriction be removed as the area is developed by the authority of the Public Works Director as authorized per Lodi Municipal Code Section 10.16.010.
