HomeMy WebLinkAboutOrdinances - No. 442In the City Council, City of Lodi, Lodi , California ORDINANCE N0.442 APPROVING THE ANNEXATION OF FORTY-FIRST ADDITION TO THE CITY OF LODI, CALIFORNIA, COMPRISING CERTAIN UNINHABITED TERRITORY IN SAN JOAQUIN COUNTY IN LOTS 47 AND 48 TNG THAT THE SAI’/iE IS ANNEXED TO AND MADE OF LAWRENCE HOMESTEAD ADDITION AND DECLAR- ~- PART OF THE CITY OF LODI. WHEREAS, in answer to a petition signed by the owner of all the real property hereinafter described in San Joaquin County, contiguous to the City of Lodi, this City Council did on the 2nd day of May, 1951, pass and adopt its Resolution No. 1608 declaring therein its intention to annex said territory to said City of Lodi pursuant to proceedings had conforming with the provisions of the Annexation of Uninhabited Territory Act of 1939, as amended, designating said territory FORTY-FIRST ADDITION as an a ppropriate name therefor, and, WHEREAS, the City Planning Commission of the City of Lodi has approved said annexation and so reported to this City Council, and, WHEREAS, said Resolution No, 1608 was published in full for two consecutive weeks in The Lodi Times, viz, on May 4 and May 11, 1951, as is evidenced by affidavit on file and of record in the office of the City Clerk of this City, and, WHEREAS, Resolution No. 1608, among other things, gave notice that owners of real property affected by said annexation might file written protests up to the hour of 8:30 o’clock porno of Wednesday, May 16, 1951, with the Clerk of this City Council, which protests would be read, heard and considered by this City Council in the City Council Chambers, City Hall, Lodi, Califbmia, at said day and hour, and, Ord. 442 - 2 WHEREAS, at that time and place, this City Council did, in open public meeting, declare that it was then ready to receive any and all protests to this proposed annexation and no protests or objections were then presented, and by reason thereof, this City Council did then and there acquire jurisdiction to adopt this ordinance and to annex said territory to the City of Lodi. Now therefore, THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS: Section 1. The annexation of the following described unin- habited territory in San Joaquin County, contiguous to the City of Lodi, designated FORTY-FIRST ADDITION as an appropriate name therefor, is hereby approved and the same is hereby declared to be annexed to and made part of the City of Lodi, to wit: PORTIONS OF LOTS 47 AND 48, LAWRENCE HOMESTEAD ADDI- TION, MAP FILED APRIL 5, 1920, IN BOOK OF YAPS AND PLATS, VOL. 10, PAGE 5, SAN JOAQUIN COUNTY RECORDS, AND OF LOCKEFORD ROAD ABUTTING THEREON: BEGINNING ON THE SOUTH LINE OF LOCKEFORD ROAD AT A POINT ON THE PRESENT BOUNDARY LINE OF THE CITY OF LODI WHERE SAID SOUTH LINE IS INTERSECTED BY THE SOUTHERLY PROLONGA- TION OF THE WEST LINE OF SAID LOT 47; FHENCE NORTH 00 29' EAST, FOLLOWING SAID CITY BOUNDARY LINE AND THE SAID WEST LINE AND ITS SOUTHERLY PROLONGATION TO A POINT 300 FEET FROM THE NORTH LINE OF LOCKEFORD ROAD; THENCE SOUTH 65' 27' EAST 607.33 FEET TO A POINT IN SAID LOT 48; THENCE SOUTH Oo 29' WEST 300 FEET TO A POINT ON THE NORTH LINE OF LOCKEFORD ROAD; THENCE CON- TINUING SOUTH 00 29' WEST ACROSS LOCKEFORD ROAD TO A POINT ON THE SOUTH LINE THEREOF AND ON Tm PRESENT CITY BOUNDARY LINE; THENCE NORTH 85' 27' WEST ON AND ALONG SAID SOUTH LINE 607,33 FEET TO THE POINT OF BEGINNING, CONTAINING 4.17 ACRES, NORE OR LESS, EXCLUSIVE OF THE PUBLIC ROAD. Ord. 442 - 3 Section 2. This ordinance shall be published one time in The Lodi Times, a weekly newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval, Section 3. Upon the effective date of this ordinance, the City Clerk shall make, certify and transmit a copy thereof to the Secretary of State of the State of California giving the date of its passage and approval and he shall also comply with the pro- visions of such statutes as may be applicable hereto to effect the purposes hereof APPROVED this 6th ------- STATE OF CALIFORNIA, COUNTY OF SAN JOAQUIN, CITY OF LODI, ss I, J. F. BLAKELY, City Clerk of the City of Lodi, County and State aforesaid, and ex-officio Clerk of the City Council of said City, do hereby certify that the foregoing Ordinance No. 442 was introduced in regular meeting of said City Coun- cil held May 16, 1951, and was thereafter, in regular meeting held June 6, 1951, passed, adopted and ordered to print by the following vote: AYES: Councilmen, BuI;& IWXELL pIzES7AER , ,RI" and TcfGWXER NOES: Councilmen, NW ABSENT : Councilmen , Nm and signed by the Mayor on the date of its final passage and that the same has been published pursuant to law. I FURTHER CERTIFY that Ordinance No. 442 was approved t
