ORDINANCE NO. 441
APPROVING THE ANNEXATION OF FORTIETH ADDITION
TO THE CITY OF LODI, CALIFORNIA, COMPRISING
CERTAIN UNINHABITED TERRITORY IN THE SOUTHEAST
ONE-QUARTER OF SECTION 11, TOlnWSHIP 3 NORTH,
RANGE 6 EAST, AKD DECLARING THAT THE SAME IS
ANNEXED TO AND MADE FART OF THE CITY OF LODI
WHEREAS, In answer to a petition signed by the owners
of not less than one-fourth of the land by area and by assessed
value of the uninhabited territory in San Joaquin County, contiguous
to the City of Lodi, hereinafter described, this City Council did,
on the 18th day of April, 1951, pass and adopt its Resolution No.
1599 declaring therein its intention to annex said territory to
said City of Lodi pursuant to proceedings had conforming with the
provisions of the Annexation of Uninhabited Territory Act of 1939,
as amended, designating said territory as FORTIETH ADDITION as
an appropriate name therefor, and,
WHEREAS, The City Planning Commission of the City of Lodi
has approved the annexation of said territory and so reported to
this City Council, and,
WHEREAS, Said Resolution No. 1599 was published in full
for two consecutive weeks in The Lodi Times, viz, on April 27
and May 4, 1951, as is evidenced by affidavit on file and of record
in the office of the City Clerk of this City, and,
WHEREAS, Resolution No. 1599, among other things, gave
notice that owners of real property affected by said annexation,
might file written protests up to the hour of 8:30 o'clock p.m.
of Wednesday, May 16, 1951, with the Clerk of this City Council,
which protests would be read, heard and considered by this City
Council in the City Council Chambers, City Hall, Lodi, California,
at said day and hour, and,

WHEREAS, At that time and place, this City Council did,
in open public meeting, declare that it was then ready to receive
any, and all protests to this proposed annexation and no protests
or objections were then presented, and by reason thereof, this
City Council did then and there acquire jurisdiction to adopt this
ordinance and annex said territory to the City of Lodi. Now there-
fore,
THE CITY COUNCIL OF' THE CITY OF LODI DOES ORDAIN AS FOLLOWS:
Section 1. The annexation of the following described unin-
habited territory in San Joaquin County, contiguous to the City
of Lodi, designated FORTIETH ADDITION as an appropriate name there-
for, is hereby approved and the same is hereby d.eclared to be
annexed to and made part of the City of Lodi, to wit:
PARCEL 1. A portion of the Southeast One-quarter of
Section 11, Township 3 North, Range 6 East: Beginning
at a point on the north line of Kettleman Lane (State
Highway 53), which point is If 1' 33'1/3l E 25 feet from
a point on the south line of said Section 11 distant
thereon 430.5 feet west from the southeast corner of
said Section; thence N 1' 33 1/31 E 127.65 feet to the
southwest corner of Lot 59, Knoll Subdivision, map filed
February 20, 1948, in Vol. 13, page 8, Book of Maps and
Plats , San Joaquin County Records; thence continuing N 1'
33 l/3' E, 337.66 feet to the northwest corner of Lot 49
in the same subdivision; thence N 89O 38' W, 100 feet;
thence N lo 33 1/3' E, 831.7 feet to the northwest corner
of Lot 1, Knoll Subdivision; thence N $9' 38 1/4' W along
the north line of the SE 1/4 of the SE 1/4 of Section 11,
660 feet to a point thereon; thence S lo 36' W, 1295 feet
to a point on the north line of Kettleman Lane; thence

S 89' 38' E on said north line, 760 feet to the point of
beginning and containing 20.68 acres, more or less.
PARCEL 2. A portion of the Southeast One-Quarter of Sec-
tion 11, Township 3 North, Range 6 East: Beginning at
a railroad spike set in the east line of said Section 11
at the northeast corner of Knoll Subdivision; thence
N Oo 15' W on the section line, 290 feet to a point;
thence N. $9' 38 1/4' W, 841.5 feet; thence S Oo 15' E,
290 feet to a point on the north line of the SE 1/4 of
the SE 1/4 of said Section 11; thence S 89' 38 1/4' E,
along said line and the north line of Knoll Subdivision
841.5 feet to the point of beginning, containing 5.6
acres, more or less.
Section 2. This ordinance shall be published one time in
The Lodi Times, a weekly newspaper of general circulation printed
and published in the City of Lodi and shall be in force and take
effect thirty days from and after its passage and approval.
Section 3. Upon the effective date of this ordinance, the
City Clerk shall make, certify and transmit a copy thereof to the
Secretary of State of the State of California giving the date of
its passage, adoption and approval and he shall also comply with
the provisions of such statutes as may be applicable hereto to
effect the purposes hereof,

I, J., F. BLAKELY, City Clerk of the City of Lodi, County
and State aforesaid, and ex-officio Clerk of the City Council of
said City, do hereby certify that the foregoing Ordinance No. 4.41
was introduced in regular meeting of said City Council held May
16, 1951, and was, thereafter, passed, adopted and ordered to
print at a subsequent regular meeting of said City Council held
June 6, 1951, by the following vote:

I FURTHER CERTIFY that Ordinance No. 441 was approved
