ORDINANCE NO. k40
APPROVING THE ANNEXATION OF THIRTY-NINTH ADDITION TO THE CITY OF LODI, CALIFORNIA,
COMPRISING CERTAIN UNINHABITED TERRITORY
HALF OF SECTION 11 > TOWNSHIP 3 NORTH, RANGE 6 EAST, AND DECLARING THAT THE SAME IS
ANNEXED TO AND MADE PART OF SAID CITY
IN THE EAST ONE-HALF AND IN THE WEST ONE-
WHEREAS, for reasons set forth therein, this City Council
of the City of Lodi did, on its own motion, initiate proceedings
pursuant to the provisions of the Annexation of Uninhabited
Territory Act of 1939, as amended, for the annexation of the
hereinafter described uninhabited territory contiguous to the
City of Lodi, by the adoption of its Resolution of Intention
No. 1597 on the 4th day of April, 1951, designating said terri-
tory as THIRTY-NINTH ADDITION as an appropriate name therefor,
and; .
WHEREAS, the City Planning Commission of this City did,
on the 12th day of March, 1951, approve said annexation and did
so report to this City Council, and;
WHEREAS, said Resolution No. 1597 was published in full
in The Lodi Times for two consecutive weeks as is evidenced by
affidavit on file and of record in the office of the City Clerk
of this City, such publication being had on April 13 and April 20,
1951, and;
WHEREAS, Resolution No. 1597, among other things, gave
notice that owners of real property affected by said annexation
might file written protests or objections thereto up to the hour
of 8:3O o'clock p.me of Wednesday, May 2, 1951, with the Clerk
of this City Council, which said protests or objections would be
read, heard and considered by this City Council in the Bity Council
Chambers, City Hall, Lodi, California, at said day and hour, and;

WHEREAS, at that time and place, this City Council did,
in open public meeting declare that it was then ready to receive
and hear any and all protests or objections to this annexation
and no persons appeared to protest against said proposed annexa-
tion nor were any written objections then and there presented,
and, by reason thereof, this City Council did there and then
acquire jurisdiction to adopt this ordinance and annex said terri-
tory to the City of Lodi, now therefore;
THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS
FOLLOWS :
Section 1, The annexation of the following described
uninhabited territory in San Joaquin County, California, contiguous
to the City of Lodi, designated as THIRTY-NINTH ADDITION, is hereby
approved and the same is hereby declared to be annexed to and
made part of said City of Lodi, to wit: ,
In Section 11, Township 3 North, Range 6 East: Begin-
ning on the present City boundary line of the City of
Lodi at the Northeast Corner of the Northwest One-
Quarter of said Section 11 and running thence South Oo
10' West along the north and south one-half section
line through said Section 11, 2650.4. feet to an axle,
South Oo 10' West 508 feet from the center of said
Section 11; thence South $9' 14.' East 660 feet to a
point on the west line of the county road known as
Walnut Avenue; thence South 0' 10' West along said
west line 968.3 feet to a point thereon; thence North
$90 30' West, 660 feet to an axle on the north and
south quarter section line; thence South 0' 10' West,
164.1.5 feet to a point on the north line of Kettleman
Lane (State Highway 53), which point is 25 feet North
o0 10' East from the quarter section corner; thence

'North L19' 079' West along said north line 795 feet to
the center line of the Woodbridge Irrigation District
canal; thence northerly along the center line of the
canal 949 feet to a point thereon; thence South 89O
074' East, 335 feet to a point 446,5 feet westerly from
the north and south quarter section line; thence North
Oo 10' East, 976,5 feet to an axle; thence South 89O
03%' East, 296.5 feet to a point 150 feet westerly from
the north and south quarter section line; thence North
0' 10' East, 3338 feet to a point on the north line of
said Section 11; thence easterly on and along said section
line 150 feet to the point of beginning, containing 54.5
acres, more or less,
Reference is here made to a map or plat on file in the
office of the City Clerk of this City delineating the boundaries
next above described,
Section 2. This ordinance shall be published one time in
The Lodi Times, the official newspaper of the City of Lodi, and
shall be in force and take effect thirty days from and after its
passage and approval.
Section 3. Upon the effective date of this ordinance,
the City Clerk shall make, certify and transmit a copy thereof to
the Secretary of State of the State of California giving the date
of its passage and he shall also comply with the provisions of such
statutes as may be applicable hereto to effect the purpose hereof,

I, J. F. BLAKELY, City Clerk of the City of Lodi, San
Joaquin County, California, and ex-officio Clerk of the City
Council of said City, do hereby certify that the foregoing
Ordinance No. 44.0 was introduced in said City Council on
the 2nd day of May, 1951, and was thereafter passed, adopted
and ordered to print at a regular meeting of said City Council
held May 16, 1951, by the following vote:
AYES: Councilmen, J$JJ& HP,SKELL PRF,SZLER.
and TOLLLVER
NOES : Councilmen, NONE
ABSENT: Councilmen, RINN
I FURTHER CERTIFY that Ordinance No, 440 was approved
and signed by the Mayor on the date of its passage and that
the same has been published pursuant to law.
