AYERS ADDITION NO. 2 fr TO THE CITY OF LODI, CALIFORNIA COMPRISING EACH OF LOTS 10, 11, 12 AND 13 OF GERAFtD TRACT. WHEREAS, in answer to a petition signed by the owner of not less than one-fourth of the land by area and by assessed value as shown on the last equalized assessment roll of San Joaquin County, of the uninhabited territory, contiguous to the City of Lodi,/this City Councii did, hereinafter described on the 21st day of June, '1950, pass and adopt its Reso- lution No. 1535, declaring therein its intention to annex said territory to said City of Lodi pursuant to proceedings had and to be had conforming with the provisions of the Annexation of Uninhabited Territory Act of 1939 as amended, designating said territory as M. F. AYERS ADDITION NO. 2 as an appropriate name therefore, and, WHEREAS, the City Planning Commission of the City of Lodi did, on the 19th day of June, 1950, approve the annexation of said territory and so report to this City Council, and, WHEREAS, said Resolution No. 1535 was published in full in The Lodi Times for two consecutive weeks as is evidenced by affidavit on file and of record in the office of the City Clerk of this City, such publication being had on June 23 and June 30, 1950, and, WHEREAS, Resolution No. 1535, among other things, gave notice that owners of real property affected by said annexatiion, Ord. 426 i. 2 might file written protests or objections thereto up to the hour of 8:00 o'clock P.M. of Wednesday, July 19, 1950, with the Clerk of this City Council, which protests or objections would be read, heard and considered by this City Council, in the City Council Chambers, City Hall, Lodi, California at said day and hour, and, WHEREAS, at that time and place, this City Council did, in open public meeting, declare that it was then ready to receive any and all protests to this annexation, and no pro- tests or objections were then offered, and by reason thereof, this City Council did then and there acquire jurisdiction to adopt this ordinance and to annex said territory to the City of Lodi, now therefore, THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS: Section 1. The annexation of the following described uninhabited territory in San Joaquin County, California, contiguous to the City of Lodi, designated +( M. F. AYERS ADDITION NO. 2 (1 , is hereby approved and the same is hereby declared to be annexed to and made part of said City of Lodi, to wit : EACH OF LOTS TEN (lo), ELEVEN (ll), TWELVE (12) AND THIRTEEN (131, AS SAID LOTS ARE DELINEATED AND so DESIGNATED ON THE OFFICIAL MAP OF TI GERARD TRACT (' FILED AUGUST 8, 1916 IN BOOK OF MAPS, VOL. 8, PAGE 62, SAN JOAQUIN COUNTY RECORDS, CONTAINING EIGHT AND ONE- HALF ACRES, MORE OR LESS, EXCLUSIVE OF PUBLIC STREETS. Section 2. This ordinance shall be published one time in The Lodi Times, the official newspaper of this City and shall be in force thirty days from and after its passage and approval. Ord. 426 - 3 Section 3. Upon the effective date of this ordinance, the City Clerk shall make, certify and transmit a copy thereof to the Secretary of State of the State of California, giving the date of its passage, adoption and approval and he shall also comply with the provisions of such statutes as may be applicable hereto to effect the purposes hereof. BLAKELY, City Clerk of the City of Lodi and ex-officio Clerk of the City Council of said City, do hereby certify that the foregoing Ordinance No. 426 was introduced in the City Council of the City of Lodi on July 19, 1950 and was thereafter passed, adopted and ordered to print at a sub- sequent regular meeting of said City Council held August 2, 1950 by the following vote: AYES: Councilmen, BULL, HAsmLL, PRESZLER, RmN & TOLLIVER NOES : Counci lmen , NONE ABSENT : Councilmen, NONE I FURTHER CERTIFY that Ordinance No. 426 was approved and signed by the Mayor on the date of its final passage and that the same has been published according to law.
